Rental Agreement – Terms & Conditions

Cancellation Policy

100% refund if canceled at least 60 days before arrival date. No refunds for ANY reasons within 60 days prior to arrival. We HIGHLY recommend buying trip insurance that offers Cancellations for ANY REASON.

Check-out: Before 10:00 AM EST (Late check-out fees will apply)

  1. GUESTS: VISITOR RULES: Only the members of the rental party identified in the booking (the “Guests”) are permitted to stay on the premises. Visitors may come to the premises, but are not permitted to stay overnight. At no time shall there be more than 18 persons in and on the premises.
  1. SMOKING: This is a NON-SMOKING house. Smoking is strictly prohibited inside the home. If any evidence of smoking is prevalent within the home, you will be charged $2,500.00 for a deep clean.
  1. FAMILY RENTAL/QUIET HOURS: We are serious about maintaining a family atmosphere for the quiet enjoyment of all guests. We will rent to family groups, married couples, and responsible adults over the age of 25. The total number of people allowed in the home and on the property at any time is restricted to the stated limit (18 people). Absolutely no loud or unruly house parties allowed. Quiet hours are 11PM to 8AM. Violators will be evicted without refund.
  1. KEYS & ACCESS CODES: You will be provided with all necessary keys and access codes. These are not to be shared by guests with other persons and shall not be used once your occupancy has ended.
  1. FURNITURE & EQUIPMENT: The home comes completely furnished and equipped with all items necessary for normal use and enjoyment. All of these items must remain on the premises upon your departure. If you break something or lose something that belongs in or around the home, notify the management immediately. In the event, you have suggestions for things that are necessary for your enjoyment, but are not there, feel free to let the management know for future consideration.
  1. PARKING: A maximum of five (5) vehicles are allowed on the property at a time. Guests may NOT bring trailers or RV’s. Small boats (maximum of 21’ in length) are permitted, provided they fit in and are kept in the garage area of the home when not in use.
  1. POOL: Pool heat is available upon request with a $75/day fee. Guests must wash off in outdoor shower prior to entering pool. Children under the age of 12 must be always accompanied by an adult while using the pool. Posted pool rules must be complied with. If the pool is left in excessively dirty shape and requires additional cleaning, a $250 charge will apply.
  1. KAYAKS: For the guests’ enjoyment, two kayaks are provided, as well as life preservers. The kayaks should only be used by experienced kayakers who are good swimmers and who must use the life preservers. Ocean currents can be unpredictable. Only veteran kayakers should venture beyond shallow water. Guests acknowledge and agree that they and their companions are using the kayaks strictly at their own risk.
  1. BEACH CHAIRS, UMBRELLAS & OTHER BEACH ACCESSORIES: These items are provided for your use and enjoyment. When you are done using these, they should be brought back to the home daily and stored where you found them. Please hose off any sand from these items before you put them away.
  1. USE OF THE BEACH AREAS: You will find miles of beautiful sand beach at your disposal. Please take caution when using the beach and especially the ocean waters, to take heed of weather warnings and currents and do not enter into water depths beyond your swimming skill level. Always have a companion when you are using the beach and the ocean waters. When you’re done and returning to the home, please hose off all sand before entering the home. Kindly do not wear wet beach shoes or wet apparel when entering the home and especially when using the furniture in the home. Property Management/Property Owner is not liable for any personal injury to the renter, their guests, or invitees, or for any damage to the tenant's property arising from the use of the beach or ocean on the Property.
  1. PETS: Only dogs are permitted in pet friendly Going Coastal properties. A maximum of 2 dogs are allowed. Going Coastal approval and a $250 per dog nonrefundable pet fee will be assessed. If this policy is violated, all guests will be immediately evicted from the Going Coastal property, all payments received from the guests will be forfeited, and the guests will be responsible for the expense of any necessary cleaning. You agree that dogs will not enter the pool, get on the furniture or linens. When outside the premises, dogs must be leashed or otherwise closely supervised. No aggressive dogs are allowed around other persons. Dogs must only urinate or defecate in appropriate places and the mess must be cleaned up by the Guest, disposing in the outside trash containers. A $500 fee will be billed against the guest if there is evidence that there has been violation of these policies. Notwithstanding this provision, Going Coastal is committed to providing reasonable accommodation to protect the rights of guests with disabilities to bring service animals or emotional support animals under the terms of The Fair Housing Amendments Act of 1988, Section 504 of the Rehabilitation Act of 1973, and Title II of the Americans with Disabilities Act. If a guest needs a service animal or emotional support animal to ease the symptoms of a disability (as defined under the above Acts), he or she should request a reasonable accommodation, in writing, from Going Coastal at the time of their reservation or as soon thereafter as feasible. The request should state that the guest has a disability and explain how the requested accommodation will be helpful. In addition, the guest should include a note from his or her service provider, such as a doctor or therapist, verifying the need for the support animal. Guests need not disclose the details of their disability, nor provide a detailed medical history.
  1. COMMUNITY AMENITIES & GATED ENTRY: The rented home is part of the Villa Del Sol gated private community. If the gate is in use at the time of your stay, you’ll be given access information. That should be shared with no other party. As part of the community, the home occupants are entitled to use of the community pool and the pickle ball courts, as well as the private access on the Bayside. You are welcome to enjoy these but must comply with all posted rules regarding their usage.
  1. CLEANING SERVICE, TOWELS & LINENS: Rates include housekeeping service only upon departure. Housekeeping is not done during your stay. Throughout your stay, you are responsible to keep the property reasonably clean and in good condition. Should you find any defects in the property during your stay, please report those promptly to Management. Upon your departure, the property should be left in the same condition as it was found by you, with only some reasonable cleaning and laundering necessary. Linens and bath towels are included with the rental; however, we do not permit bath towels, blankets, or linens to be taken from the home and/or used on the beach. Separate beach towels are also provided. Damages will be assessed for any linens/towels that are missing and/or have been misused.
  1. AMENITIES: Exclusive Molton Brown soaps and many other amenities are provided for the Guests’ use and enjoyment while staying at the property. They are not meant to be taken from the property. If Molton Brown products are removed from the property, the Parties will be charged retail value for whatever is missing from the home.
  1. TRASH: Please place your trash in the receptacles outside the home and use bear latches. Guests are responsible for picking up any trash that bears get into due to not using bear latches on cans at all times.
  1. DAMAGE POLICY: Guests are responsible for the property, its contents, and themselves during occupancy. Guests must lock windows and doors securely when not on the premises. Rearranging the furniture or removing any items from the property is prohibited. Guests shall not make any alterations, additions or improvements to the property, including, without limitation, installing any fixture, apparatus, equipment, paint, or device of any kind in or upon the interior or the exterior of the property, or cut or drill into the property. Guests shall keep the property reasonably clean and tidy. After check-out, Going Coastal will inspect the property for damage, missing items, and abnormally dirty appearance. During that inspection, if Going Coastal determines damage is present, items are missing, or the property is abnormally dirty, Going Coastal will repair the damage, replace the missing items, and/or perform a deep clean of the property at the guest’s expense. Guest authorizes Going Coastal to charge the credit card on file to reimburse it for any such expenses.
  1. FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money payment.
  1. LICENSE TO OCCUPY/VIOLATION OF AGREEMENT: The parties acknowledge that, by virtue of this Agreement, Going Coastal is granting a revocable license for guest, and guest’s invitees, to occupy the Going Coastal property subject to the terms of this Agreement. Going Coastal may revoke this license at any time guest or guest’s invitees are in default of any provisions of this Agreement, including but limited to maximum occupancy. Upon such revocation, guests will immediately vacate the property, with no refunds issued. It is mutually agreed and understood that this Agreement is not intended to create a Landlord-Tenant relationship by and between Going Coastal and guest and that Florida’s Landlord and Tenant Act in Chapter 83, Florida Statutes, shall not apply. This Agreement is not assignable by guest. Any purported assignment hereof shall be void and of no force or effect.
  1. POOL MAINTENANCE: Pool maintenance and cleaning are provided by Going Coastal and outside contracted companies. Parties agree to allow pool personnel on the property during their stay to clean the pool, test and add pool chemicals, repair and maintain pool equipment, and turn pool heat on and off at any time.
  1. POOL ALARM POLICY: Pursuant to the Residential Swimming Pool Safety Act found in Section 515.27, Florida Statutes, swimming pools must have certain safety features, such as fencing and/or door alarms, depending on the pool configuration. If any pool alarm at any door or window leading to the pool area is not working, please contact Going Coastal immediately. Should a disabled or tampered with pool alarm be found upon guest’s departure, a $1,000 fee will be charged against the guest credit card on file in addition to any costs expended to replace or repair the pool alarm.
  1. ACTS OF GOD; HURRICANE AND TROPICAL STORM POLICY: No refunds will be made for weather-related reasons, including such things as Hurricanes or Tropical Storms, even if evacuation orders have been issued. Owner and Management Company will not be liable or deemed in default for any failure to perform or for delay in performing any obligations due to or arising out of any act not within their control, including, without limitation, acts of God. We highly recommend getting TRAVEL INSURANCE for your trip. It is up to the Guest to purchase this coverage for their trip. Coverage is available for health and weather-related problems. One company that offers such coverage can be found at insuremytrip.com and provides many options. You may order online to purchase this in your name.
  1. WILDLIFE: Please note that Cape San Blas is a natural habitat for many species of wildlife including snakes, alligators, bobcats and bears. Always maintain awareness of your surroundings and accompany children and pets while outside.
  1. MECHANICAL FAILURES: Owner/Property Management Company always attempts to properly maintain the Property in superior condition for your enjoyment. While all electrical and mechanical equipment within the Property are in good working order, Owner/Property Management Company cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air conditioning, internet access, cable service, or appliances. Guest agrees to report any inoperative equipment or other maintenance problem to Property Management Company immediately. Property Management Company will make every reasonable effort to have repairs done quickly and efficiently. Guest will allow Property Management Company, or a person permitted by Property Management Company access to the Property for purposes of repair and inspection. Owner or Property Management Company is not responsible for any inconvenience that may occur and no refunds or rent reductions will be made due to failure of such items.
  1. LIMITATION ON LIABILITY: Owner or Property Management Company is not responsible for any accidents, injuries or illness that occur to any member of the Rental Party or Guest’s visitors while in the Property or on the Property. Owner or Property Management Company is not responsible for loss of personal belongings or valuables belonging to any member of the Rental Party or any of Guest’s visitors. Guest agrees to assume the risk of any harm arising from use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL OWNER OR PROPERTY MANAGEMENT COMPANY BE LIABLE TO GUEST OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY.
  1. INDEMNIFICATION: Guest acknowledges that the use of the Property by the Guests and their visitors is entirely at their own risk. Guest will indemnify and hold harmless Owner and Property Management Company from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of or damage to personal property, injury or death resulting from the use or occupancy of the Property.
  1. APPLICABLE LAW: The rental agreement is governed by the laws of the State of Florida and any local governmental rules and regulations that are applicable.

As part of the booking process, you have agreed to the terms of your temporary occupancy of this home. Listed above are additional terms and conditions applicable to your usage. By booking this property and taking occupancy, you and your guests acknowledge that you have read, understand, and agree to abide with all of the terms of conditions expressed herein.
