Vacation Rental Agreement

Welcome to The Calm Life at Sunrise Beach Resort, Unit 1606. This short-term vacation rental agreement explains the rental policies for our property. Our goal is for your stay to be wonderful and meet all of your expectations. If you have any questions, or if anything in the condo is not working during your stay, please email or call us and we will get it resolved.

Rental Agreement: This agreement is a contract between the Guest (you, your) and the Owner (we, us, our) of the vacation rental property (the property). By accepting this agreement, you and everyone in your party agree to all of its terms and conditions, as well as The Calm Life Guest Agreement & House Rules, which we will provide with your booking confirmation. This is a transient rental under Florida law, meaning your stay is temporary and limited to your reserved dates. The property may not be sublet or assigned to anyone else. Please do not make any repairs, alterations, or improvements to the property.

Confirmation of Reservation: Your reservation is confirmed once we receive your electronically accepted rental agreement and the advance payment described below. The person named on this agreement must be an adult at least 25 years old and is responsible for the reservation and all rental obligations.

Minimum Stay: A minimum stay of 5 nights is required for all reservations.

Payment: Payment is made by credit card. An advance payment of 50% of the rental amount is due at the time of booking and is applied toward your rent. The remaining balance is due 30 days before your arrival date. Reservations made less than 30 days before arrival require full payment at the time of booking. A non-refundable fee for ivacationonline.com Warranty Protection (IWP), described below, is also charged at the time of booking.

Cleaning Fee and Housekeeping: A one-time cleaning fee of $190 applies to each reservation. Linens and bath towels are provided. Daily housekeeping is not included.

ivacationonline.com Warranty Protection (IWP): ivacationonline.com Warranty Protection (IWP) is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

Cancellation: Cancellations made 60 or more days before check-in will receive a full refund of all payments, except the non-refundable IWP fee. Cancellations made 30 to 59 days before check-in will receive a 50% refund of payments made, excluding the IWP fee. Cancellations made fewer than 30 days before check-in are not refundable.

Severe Weather and Hurricanes: Refunds are not provided for severe weather, including tropical storms and hurricanes. However, if a mandatory evacuation order affecting your reserved dates is issued for Panama City Beach, we will work with you on an agreeable solution, which may include a refund, rebooking for new dates, or another option. We highly recommend purchasing travel insurance to protect your trip.

Travel Insurance Provided by TRAVEL GUARD: Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.249.5376 or www.travelguard.com/astp/inland). Insurance: You are expressly excluded from any insurance policy held by us. We suggest that you carry renter's insurance to cover your personal belongings.

Arrival and Check-in: Check-in is 3 PM local time on your scheduled arrival date. Early check-in is not guaranteed, as time is needed to clean the property before your arrival. Once we receive full payment and your accepted rental agreement, we will send detailed check-in instructions, including your door code and vehicle registration information.

Departure and Check-out: Check-out is 10 AM local time on your scheduled departure date. Late check-out is not available, so the property can be cleaned before the next guest arrives. We will provide check-out procedures before your arrival.

Maximum Occupancy: The maximum number of guests is 6, per local fire code. Only guests registered with us may stay overnight at the property. Exceeding the maximum occupancy is a breach of this agreement and will result in eviction with no refund.

Parking: Parking is limited to 2 vehicles. Vehicle registration is required by Sunrise Beach Resort and must be completed before your arrival. You are responsible for the registration process and the registration fee of $50 per vehicle. Unregistered vehicles are subject to towing and/or fines. We will provide registration instructions before your arrival.

Beach Service and Pool Access: Complimentary beach chair and umbrella service is available from March 15 through October 31. Wristbands are required for both pools and hot tubs and are provided inside the unit for use during your stay. Fees may apply for wristbands that are lost or removed from the unit.

Utilities: Normal utility usage, Wi-Fi, and basic cable are included with your stay. Any pay-per-view purchases are your responsibility.

Property Care: Please treat the property with care and return it in the same condition you found it, apart from normal wear and tear. You agree to follow The Calm Life Guest Agreement & House Rules, which cover the care of furnishings, floors, doors, windows, and the balcony. Throwing objects from the balcony is a felony under Florida law.

No Pets: Pets are not allowed at Sunrise Beach Resort. This rule is set by the Homeowners Association, not by us. If a pet is found at the property during your stay, you may be asked to vacate immediately with no refund. If evidence of a pet is found after your departure, additional cleaning fees will apply.

No Smoking or Open Flame: Smoking of any kind, including e-cigarettes and vaping, is not allowed inside the property or on the balcony. Candles and open flames of any kind are also not allowed inside the property or on the balcony. If evidence of smoking or open flame is found after your departure, additional cleaning fees will apply.

Community Rules: You agree to follow all rules of Sunrise Beach Resort, which are posted inside the property and/or at the resort office. These rules are subject to change at any time. Violators are subject to eviction by security or local police.

Criminal Activity: You agree not to engage in any criminal conduct at the property, including but not limited to using illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, or engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a third party while engaging in criminal activity.

Damage: Please inspect the property on your arrival day and report any broken items, damage, or other issues to us right away. Any damage that occurs during your stay must also be reported to us immediately. Damage to the property, whether reported by you or found after your departure, will be submitted under IWP. You are responsible for any damage not covered by IWP or exceeding its coverage amount, and these costs will be charged to the credit card on file.

Maintenance and Repairs: Even the best equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Please report any issues that may require maintenance promptly so we can arrange repairs as quickly as possible. Authorized personnel may enter the property during business hours, or at any time in an emergency, for repairs, care, or maintenance.

Conditions Beyond Our Control: We are not liable for events beyond our control that interfere with your scheduled stay, including but not limited to acts of God, government actions, fire, strikes, war, hurricanes, tropical storms, severe weather, or loss of electricity or water. Except as described under Severe Weather and Hurricanes, no refunds are provided in these circumstances. We recommend purchasing travel insurance before your arrival.

Indemnification: To the fullest extent permitted by law, we are not liable for any damage or injury suffered by you, members of your party, your guests or invitees, or any other person entering the property during your stay. You agree to indemnify, defend, and hold us harmless from any and all claims arising from your stay or the actions of anyone in your party.

Falsified Reservations: If you provide false information about your identity or any other part of the reservation, you will forfeit the reservation, will not be granted access to the property, and will not be refunded any money paid. We have the right to report the fraud to the appropriate authorities.

Governing Law: This agreement shall be governed, construed, and interpreted under the laws of the State of Florida.

Severability: If any part of this agreement is held to be invalid, the rest of this agreement will remain valid and enforceable.

Acknowledgement: You have read and agree to the terms and conditions of this agreement, including The Calm Life Guest Agreement & House Rules, the Sunrise Beach Resort community rules, and the weather, pet, smoking, and cancellation policies. You authorize us to charge the credit card provided at booking for rental payments and for any other charges described in this agreement.
