RENTAL AGREEMENT
RENTAL AGREEMENT: This Agreement (agreement) constitutes a contract between the Guest (you, your) and Koastal Komfort Vacation Rentals LLC, hereinafter referred to as KKVR, Homewner (us, we, our) of the Vacation Rental Property (property). Guests acknowledge, understand, and agree that by making a reservation deposit and providing reservation information, they have accepted all terms and conditions listed in the rental agreement including our cancellation policy. Your vacation rental is a transient rental under state law. This means that your tenancy is temporary for the stated time period only. The rental property cannot be sublet, and your reservation is not transferable to another party. Violations of this policy will result in immediate eviction. Please do not make any repairs, alterations, or improvements to or about the property.
PROPERTY: The condo is in Miramar Beach, Florida. The exact location will be provided the week of your arrival.
RESERVATION: A down payment of 50% of the total rental fee is due at booking. Note this is not a security deposit. The remaining balance is due 60 days prior to check-in date. Reservations made less than 60 days prior to arrival require full payment at the time of booking.Your booking is confirmed when you have accepted the rental agreement and we have received your down payment. KKVR has the right to cancel and open the unit up for rental if there is an unpaid balance within 60 days prior to check-in date.
*Summer rentals (May 25 - July 13) Saturday - Saturday for weekly OR 6 night min between Saturday - Saturday. Guest will be charged a cancellation fee if booking is made outside of these days and Homeowner has to cancel.
*Reservations of 28 days or more require final balance to be paid 90 days prior to arrival date.
FORMS OF PAYMENT: Payments must be made on Guest's credit card.
MINIMUM RENTAL AGE: KKVR will not rent to anyone under the age of 25. We reserve the right to terminate or reject reservations if made under false pretenses (No refunds will be given). The Guest on this rental agreement must be at least 25 years old, must be staying in the unit during the entire agreed rental period, and will be the responsible party for the reservation and all rental obligations.
RENTAL PARTY: The Rental Party shall consist of the number of guests (Adults, Children) listed on your reservation. People other than those in the Rental Party may not stay overnight on the property. Any other person in the property is the sole responsibility of the Guest.
MAXIMUM OCCUPANCY: The maximum number of guests is limited to 8 people. This applies to day visitors and children as well. Usage of the property for large gatherings, house parties, family reunions, and weddings is not allowed. Occupancy over the indicated amount may result in eviction and no money will be refunded.
TERM OF THE LEASE: The lease begins at 4PM on arrival date (time/check-in date) and ends 10AM on departure date (time/check-out date).
CANCELLATION POLICY: Cancellations made more than 60 days prior to your arrival will receive a total refund of any advanced payments less a $250 cancellation fee.
Cancellations made within 60 days of the check-in date will receive no refund and you will forfeit any money paid in advance. Written notice of cancellation at least 60 days prior to arrival is required.
If Homeowner has to cancel a reservation, the cancellation fee is left up to Homeowners discretion.
No refunds will be issued for early departure and/or evictions. We Highly recommend all guests purchase travel insurance.
HURRICANE POLICY:
REFUNDS
Refunds (less a $250 cancellation fee) will be given due to the following conditions:
HURRICANES: A "mandatory evacuation order has been given for the Hurricane Warning" area of the residence of a vacationing guest and you choose to evacuate.
The day the authorities order a mandatory evacuation order in a "Hurricane Warning" area we will refund:
No refunds will be given for a Tropical Storm only.
We encourage all our guests to buy independent travel insurance in case the unforeseen happens prior or during your trip.
TRAVEL INSURANCE PROVIDED by TRAVEL GUARD: Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.249.5376 or www.travelguard.com/astp/inland). INSURANCE: You are expressly excluded from any insurance policy held by us. You understand that it is suggested that you carry renter's insurance to cover your personal belongings.
RENTAL RULES: Guests agree to abide by all rules governing the community where the property is located, the rental rules within this rental agreement and with all condominium rules and regulations and to commit no nuisance while occupying the property. And shall cause all members of the Rental Party and anyone else Guests permits on the property to always abide by these rules and regulations while at the property.
RIGHT OF ACCESS: Guests shall allow the Homeowner and/or Homeowner’s agent access to the property for purposes of inspection and repair. Homeowners shall exercise this right of access in a reasonable manner.
NO PETS: Our community does NOT allow pets. This is not a decision made by us, this is a rule set by the Homeowners/Condominium Associations. If a pet is found on the property during your stay, we have a right to ask you to vacate the property immediately with no refund of any kind. Upon departure, if the cleaning company detects any evidence of a pet, additional fees may apply and will be charged to the credit card on file.
NO SMOKING OR OPEN FLAMES: Smoking is NOT allowed in common areas, inside the unit or on the balcony. NO candles or open flames of any kind are allowed inside the property. Additional fees may apply and will be charged to the credit card on file if evidence of smoking and/or open flames are detected. Walton County strictly forbids any gas grills or open fires on the balcony. Any violation could result in criminal prosecution, eviction, and forfeiture of any monies. Charcoal grills are available throughout the complex.
REPAIRS: Notify Owner immediately if something is damaged or not working properly so the item can be fixed and/or replaced. All amenities such as appliances, air conditioners, heaters, TVs, cable & internet, etc. occasionally malfunction and cannot be guaranteed 100% of the time. We will make every effort to correct the problem as soon as possible during normal business hours. THERE WILL BE NO REFUNDS. KKVR is not responsible for Guests inability to operate equipment.
REMODELS, BUILDING, IMPROVEMENTS: KKVR is not responsible for remodels, improvements, or new construction of condos, homes, or commercial properties nearby. There will be no refunds or discounts.
PROPERTY DAMAGE: Guests shall notify Homeowner immediately upon arrival if they notice any damage to the property to avoid being charged for repair. Guests are financially responsible for damage to the property and its contents (excluding normal wear & tear) from the date and time of check-in to the date and time of check-out. Any damage or accident not covered under the damage policy will be charged to the credit card on file.
HOLD HARMLESS AND INDEMNITY: Homeowner shall not be liable for any damage, accidents, injuries, or illness that occur while on the premises or its facilities. The Homeowner is not responsible for the loss of personal belongings or valuables of the Guests. You agree to idemnify KKVR for any damages to the condo, grounds, furnishings, equipment, and household items therein, excluding normal wear and tear, which occur during your occupancy period. All amenities associated with the rental property and the surrounding area are used at the Guests’ own risk. By accepting this reservation, you are expressly assuming the risk of any harm arising from your use, as well as the use of others whom you invite to use the premises and the surrounding areas. You agree to hold KKVR, its employees, officers, and representatives harmless against any claim for damage or injury, no matter how caused.
ACCIDENTAL DAMAGE PROTECTION:

ivacationonline.com Warranty Protection (IWP) is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.
The purchase of the insurance still requires you to follow the check-out list outlined in the check-out details, and you must follow all terms and conditions.
NOISE ORDINANCE: Guests understand that Walton County has a strict code enforced noise ordinance.

FURNISHINGS: Guests must keep the property and furnishings in good order
The American Academy of Pediatrics recommends that no child under age 6 sleep in the upper bunk.
PARKING: Seascape Resort is a secure gated property. Guests are allowed passes for 2 vehicles only. Parking passes are included with your reservation and will be in the unit upon arrival. Guests are required to display a valid parking pass while on the premises. Failure to display a parking pass may result in a ticket or towing of vehicle at Guest’s expense. Oversized vehicles (trailers, boats, RVs) are not allowed to park in Seascape. Any parking violations during your stay will be charged to the credit card on file.
AIR CONDITIONING: Please do NOT set the air conditioner below 72°F as this may cause the unit to freeze, resulting in an inoperable system. Do NOT leave the balcony doors open while running the air conditioner.
POOL & FITNESS CENTER BRACLETS: Yellow activity bracelets are provided and must be worn at all times while at the pool, fitness center and shared Seascape amenities. Children under 12 years of age are not required to wear a bracelet. Bracelets must be returned before departure. Guest's credit card will be charged $30 for each missing bracelet.
Glass is NOT allowed in the pool area
HOUSEKEEPING: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the unit to the beach or pools.
BEACH TOWELS: We provide beach towels for Guests use at the beach and pools. Guests must wash and dry beach towels prior to check-out.
Do NOT hang beach towels or any other items from the balcony. Please feel free to use the drying rack to assist in the drying of swimsuits, clothing, and towels.
Do NOT throw items from the balcony! Throwing any item from a balcony is a FELONY in the state of Florida.
BEACH ITEMS: Please spray off beach items and wagon after each trip to the beach. Make sure the wagon is completely dry before folding it back up.
TURTLES: May-October is turtle nesting season. Remember to fill in any holes dug in the sand and level any sandcastles built prior to leaving. We want the females and hatchlings to have a clear and safe pathway with no obstructions that may trap them. If you have the privilege of seeing a turtle come to shore to nest stay back and give her space – simply be in the moment! Please do not take pictures or videos as this will prevent her from nesting. All sea turtles are protected by the Endangered Species Act and it is a felony to interfere with nesting or hatchlings.
ARRIVAL: Check-in is at 4:00 PM local time. No early check-in please. Check-in instructions will be provided the week before arrival. Door code will be sent out 1 day prior to arrival date.
**Final Payment and Rental Agreement must be received before check-in instructions/door code are provided.
DEPARTURE: Check-out is at 10:00 AM local time. There are no late checkouts.
CONDITIONS BEYOND OUR CONTROL: We are not responsible or liable, in whole or in part, for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, ice storm, severe weather, inclement weather, loss of electricity, or loss of water, any delays or changes in arrival or departure times, fare changes, any vehicle or airline reservations, missed carrier connections, sickness, disease, injuries (including death), losses, expenses, damages, and any other expenses that may occur. There will be no refund in these circumstances. We recommend you purchase travel insurance prior to arrival.
CRIMINAL ACTIVITY: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.
INDEMNIFICATION: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.
GOVERNING LAW: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.
SERVERABILITY: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.
FALSIFIED RESERVATIONS: If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have a right to report the fraud to appropriate authorities.
ACKNOWLEDGEMENT: You have read, understand and agree to the terms and conditions of this rental agreement including the rental rules, community rules, noise ordinance, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only. You understand that the Homeowner may cancel your reservation at anytime with reasonable discretion.
