The PALMS RENTAL AGREEMENT

Thank you for choosing our home for your vacation. We hope that you have a pleasant stay.

To confirm your reservation, please fill out, sign and return the rental agreement. Read and

save the rules and regulations. We will confirm your reservation upon receipt of a signed

rental agreement. We cannot hold a reservation without this paperwork.

Description: 2-Story house. 4 bedrooms/4.5 bathrooms

Check-in Time : 4pm CST (No early check-in please)

Check-out Time: No Later than 10am CST

DAMAGES: Guests are liable for all replacements and repairs that a reasonable person

would consider outside normal wear and tear.

CANCELLATIONS: A sixty (60) day notice is required for cancellation. Cancellations that

are made more than sixty (60) days prior to the arrival date will incur no penalty.

Cancellation or early departure does not warrant any refund of rent or deposit.

MAXIMUM OCCUPANCY: The maximum number of guests is limited to 10.

AGE REQUIREMENT: We will not rent to vacationing students or singles under 27 years

of age unless accompanied by an adult guardian or parent. We rent to families and

responsible adults over the age of 27. Proof of age is required. We maintain a family

atmosphere for the quiet enjoyment of all guests.

ASSUMPTION OF RISK: No lifeguard is on duty. Accordingly, persons using the beach or

pool do so at their own risk and the owner assume no responsibility for accident or

injury. No one should swim alone. Renters will hold the Owners harmless from any and

all bodily injury and/or property damage incurred on the property arising out of the

Renter’s negligent acts or omissions.

NO SMOKING: This is a NON SMOKING vacation rental. Smoking is not allowed

inside or outside the home. Any evidence of smoking, such as the smell of cigarette

or cigar smoke inside the home by the cleaning staff is sufficient basis to charge the

renter for smoke cleanup and removal from the rugs, AC ducts & filters and

furniture. This type of clean up is expensive and the renter is liable for the deep

cleaning costs incurred.

HURRICANES & TROPICAL STORMS: There are NO REFUNDS for hurricanes, tropical

storms or weather conditions, even if a mandatory evacuation is ordered. The renter

may choose to seek optional travel insurance protection through a third party.

CHILD PROOFING: Guest understands that no special efforts have been made to

“childproof” this house, and accept the risk or harm to any children we allow on the

property. These risks are not limited to, but include access to the ocean, pool, adjacent

street, cleaning supplies in the house and plants in the house, patio and on the street,

that may be poisonous if ingested.

INDEMNIFY: This house is privately owned; the owners are not responsible for any

accidents, injuries or illness that occurs while on the premises or its facilities. The

homeowner is not responsible for the loss of personal belongings or valuables of the

guests. By accepting this reservation, it is agreed that all guests are expressly assuming

the risk of any harm arising from their use of the premises or others whom they invite to

use the premise.

WARRANTY PROTECTION: ivacationonline.com Warranty Protection (IWP) is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

ï‚· This is a NON SMOKING home. Any evidence of smoking found in home will result in

charges for additional cleaning and deodorizing as needed.

ï‚· PETS are NOT permitted in rentals under any conditions. If you bring a pet(s),

this rental agreement will be forfeited and terminated. If a pet or evidence of

a pet is found on the property, a $500 fee will be charged.

ï‚· We will not rent to vacationing students or singles under 27 years of age unless

accompanied by an adult guardian or parent.

ï‚· Also note, guest is agreeing by signing that they are liable for any damages during

their stay, including but not limited to:

a) IF THE AIR CONDITIONING IS ON AND THE DOORS/SLIDERS ARE LEFT OPEN

FOR MORE THAN 10 
MINUTES, THE AIR UNIT WILL FREEZE AND RESULT IN A

SERVICE VISIT THAT WILL BE DEDUCTED FROM YOUR DAMAGE DEPOSIT OF

$350.00 PER TRIP BY THE SERVICE MAN!

b) Food stains on bedding or upholstery will also result in a cleaning bill. 


c) No damage is done to the home or its contents, beyond normal wear and

tear. 


d) Items should not be removed/taken from the property. If items are found

missing from the home at your departure, a fine of $250 will be assessed

along with replacement cost.

e) Due to any charges are incurred due to contraband, collection of rents or

services rendered during the stay. 


f) Utilize Tuesday and Friday for trash pickup. 
Do not wait until departure day

for discarding trash.

g) Dishes are placed in the dishwasher and cleaned and no open food containers

are left. 


h) Guest should not create excessive noise at a level that disturbs the neighbors:

Code-enforced neighborhood quiet hours are from 10pm - 8am.

i) All charges accrued during the stay are paid prior to departure. 


j) No linens are lost or damaged. 


k) If movies are 
rented, you will be charged for this cost. 


l) We are not responsible for personal items left in the home. If the items are

found and you wish them returned, there will be a $25 service charge plus

shipping cost.

m) Please do not rearrange the furniture, take any items outside that are part of

the interior décor. Charges may occur if the housekeepers have to rearrange

the furniture after your stay.

ï‚· INCLUSIVE FEES - Rates include a one-time linen-towel setup. We do not permit

towels or linens to be taken from the home. We encourage guests to bring beach

towels as the home does not include these.

ï‚· NO DAILY MAID SERVICE - While linens and bath towels are included in the unit,

daily maid service is not included in the rental rate. However, it might be possible

to schedule extra days of maid service at the renter’s expense.

ï‚· UTILITIES: The operation and maintenance of utilities is out of our control. No

compensation will be given for temporary outage of electricity, water, cable or

internet service.

ï‚· FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be

subject to forfeiture of advance payment, deposit and/or rental money, and the

party will not be permitted to check-in.


 WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must
be

approved in writing in advance.

ï‚· HEATING/COOLING POOL: Pool heating or cooling must be ordered at least

2 days before arrival and for the entire length of your stay. Pool Heaters are

connected to the Pool Pump, which operates on a timer, which is set to

come on in the morning and turn off in the evening (runs for 8 hours). The

pool heater will not work at night. There is an additional charge of

$300/week to heat or cool the pool.

o Electric Pool heaters/exchangers need to run for at least 24 hours in

order to produce heat.

o Electric Pool heaters are heat exchangers and generate heat off the

outside temperature, so if the outside temperature is 70 degrees the

pool will eventually get to 70 degrees over a period of 24-48 hours

then will increase by 1 degree per hour.

o Electric Pool heaters/exchangers: The pool is heated by an electric

heat pump. The desired water temperature is set at 86 degrees

Fahrenheit. It is important to note that this temperature will not feel

“hot” like a spa, nor “warm” like a bathtub. It is only meant to take

the chill off the water so you may swim comfortably. When the air

temperature drops below 55 degrees Fahrenheit the pump (which

sucks in air as part of its operation), although on and operating, may

not be able to bring the water fully up to desired temperature.

However, the operating costs remain the same and no refunds can be

made should the water not reach temperature in this circumstance.

o Please do not attempt to adjust the pool heating yourself as it is very

easy to break it and very expensive to fix.

o If a guest has tampered with the pool heating controls or lock box on

the heater unit a minimum charge of $150 will be charged to the

guest.

  • INCLUSIVE FEES - Rates include a one-time linen-towel setup. We do not permit towels or linens to be taken from the home. We encourage guests to bring beach towels as the home does not include these.
  • NO DAILY MAID SERVICE - While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. However, it might be possible to schedule extra days of maid service at the renter’s expense.
  • UTILITIES: The operation and maintenance of utilities is out of our control. No compensation will be given for temporary outage of electricity, water, cable or internet service.
  • FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.

  • WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must
be approved in writing in advance.
  • HEATING/COOLING POOL: Pool heating or cooling must be ordered at least 2 days before arrival and for the entire length of your stay. Pool Heaters are connected to the Pool Pump, which operates on a timer, which is set to come on in the morning and turn off in the evening (runs for 8 hours). The pool heater will not work at night. There is an additional charge of $300/week to heat or cool the pool.
    • Electric Pool heaters/exchangers need to run for at least 24 hours in order to produce heat.
    • Electric Pool heaters are heat exchangers and generate heat off the outside temperature, so if the outside temperature is 70 degrees the pool will eventually get to 70 degrees over a period of 24-48 hours then will increase by 1 degree per hour.
    • Electric Pool heaters/exchangers: The pool is heated by an electric heat pump. The desired water temperature is set at 86 degrees Fahrenheit. It is important to note that this temperature will not feel “hot” like a spa, nor “warm” like a bathtub. It is only meant to take the chill off the water so you may swim comfortably. When the air temperature drops below 55 degrees Fahrenheit the pump (which sucks in air as part of its operation), although on and operating, may not be able to bring the water fully up to desired temperature. However, the operating costs remain the same and no refunds can be made should the water not reach temperature in this circumstance.
    • Please do not attempt to adjust the pool heating yourself as it is very easy to break it and very expensive to fix.
    • If a guest has tampered with the pool heating controls or lock box on the heater unit a minimum charge of $150 will be charged to the guest.
