Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $1500.00 unless you opted to pay the $1500 security deposit in lieu of the insurance. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder. No Fireworks allowed on premises without permission from the owner No Smoking inside the cabin. There will be an additional charge of up to $500 to remove smoke smell from the cabin including carpets and furniture cleaning. Pets: Pets are not permited. In the event you are found to have brought a pet during your stay, you may be required to vacate the premises without refund and there will be an additional cleaning fee of up to $350 Do not re-arrange any of the furniture... there will be an additional charge for excessive cleaning if additional time is spent due to furniture being out of place. "Check out is at 10a.m. EST. No exceptions, please. Housekeeping must be able to enter the cabin at 10a.m. Realize that they only have a limited amount of time to get the cabin ready for the next guests, so please be on time. If you have not left the cabin when housekeeping arrives, you will be charged a fee of $100. If your late checkout prevents the next guest from checking in, then you will be charged for an additional night. In the event that guest has not vacated the property by 10am on the date scheduled for departure and owners or housekeeping find that guest is not present, owner or housekeeper will remove the guests belongings and hold at another location for guest to pick up. (this will only take place in the event the guests late checkout would prevent the next guest from checking in that day. We will make every effort to contact you should this occur). You will be charged an excessive cleaning fee of $100 should this occur. Hot Tub: Use of the hot tub is at your own risk. Children using the hot tub must be supervised by an adult at all times. Do not dive into the hot tub. Do not stay in the hot tub for more than 20-30 minutes at a time so that your body does not overheat. Do not use the hot tub while or after consuming alcoholic beverages. Do not eat or drink while in the hot tub. Do not use bubbles or any type of soap in the hot tub. Do not use the hot tub if you are pregnant or if you have pre-existing health problems. Water in the hot tub is chemically treated with bromine tablets which can damage some jewelry finishes. Please. . . . Do not sit on hot tub cover. Do not allow children to play on hot tub cover. Do not place heavy items on hot tub cover. Damages to the hot tub cover will result in a charge of $300 to have it replaced. Departure: : Renter agrees to leave home in a respectful state. Linens will be replaced by cabin services. Please place all trash in the trash receptical provided outside. There will be a $100 charge for excessive cleaning. "UTILITIES: The Owner will provide water, heat, electric, trash removal. Locked Areas: Guest agrees not to tamper with or enter any locked areas containing owners personal effect. If locked areas are found to be tampered with guest agrees to pay for any damages, loss or repairs resulting from their entry of locked area. Hot Tubs, Whirlpools, Appliances, etc: Should you have any trouble with the hot tub, whirlpool (if any) or any of the appliances, please do not attempt to repair yourself. Please contact owner immediately if this occurs! MAXIMUM NUMBER OF OCCUPANTS: The house is to be occupied by no more than 6 (Six) persons at a maximum. We will not rent to vacationing students or singles under 21 years of age unless accompanied by an adult guardian or parent. No chaperoned groups VIOLATION OF THIS PROVISION SUBJECTS LESSEE TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM VACATION RENTAL. WEATHER / There are no refunds for inclement weather. This home is located in the foothills of Tennesse . It is recommended that you come prepared for snow during the winter months with 4 wheel drive and/or snow chains. LESSEEassures the LESSOR that the tenants and/or their guests will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner not offensive to neighbors LESSEEassures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant’s guest(s). LESSEEagrees that any tenant and/or guest who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises LESSEEand/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises. LESSEEagrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; LESSEEagrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the LESSEE, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises. LESSEEagrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones. Upon not less than 24 hours notice, LESSEE shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants. In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from LESSEE. LESSEEmay not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR. If LESSEE abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property. In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney’s fees as fixed by the Court in addition to all relief at law or equity. Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law. LESSEEassumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accordance with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the LESSEE. PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION. VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEWER. THEREFORE, IN THE EVENT LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN SIX PERSONS, LESSEE SHALL BE RESPONSIBLE TO PAY LESSOR.THE-SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS OF SIX PERSONS PER DAY FOR EACH DAY THE LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN SIX PERSONS. CREDIT CARD AUTHORIZATION:I understand and consent to the use of the credit card provided without original signature on the charge slip, that a photocopy or fax of this agreement will serve as an original, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include: unauthorized long distance telephone and satellite TV charges; damages beyond normal wear and tear; unreturned keys, excessive cleaning required after your departure, damages to towels and/or linens, damages of any kind to owners personal property, furniture, appliances, locked areas, etc. We reserve the right to require a minimum amount of nights for certain holidays. We require 4 nights for Memorial Day, Labor Day, and 4th of July Holiday Weekends, Thanksgiving, Christmas and New Years stays.
