Vacation Rental Agreement

This is your short-term vacation rental agreement. This agreement outlines everything you need to know about our rental policies for our property. Our goal is to ensure that your stay at our property is wonderful and meets all of your expectations. Please let us know if you have any issues during your stay and we will get it resolved. Rental Agreement: This Agreement (agreement) constitutes a contract between the Guest (you, your) and Gates in Florida LLC (us, we, our) of Destiny Hideaway (property). By signing this agreement, you and your guests are agreeing to all terms and conditions listed in the rental agreement. Your vacation rental is a transient rental under state law. This means that your tenancy is temporary for the stated time period only. At no time is the property to be sublet or assigned to another individual. Please do not make any repairs, alterations, or improvements in or about the property.

Confirmation of Reservation: Your reservation is confirmed when we receive your electronically signed rental agreement and an advance payment equal to 50% of the rental rate. The name on this agreement must be an adult who is at least 25 years old, and will be the responsible party for the reservation and all rental obligations. This guest must stay at the property for the duration of the rental agreement.

Intended Use: This property is located in a cul-de-sac in a gated community and is intended for families and adult groups. This vacation rental is not intended for house parties or group functions, including but not limited to student groups, graduation, prom, fraternity/sorority, club, or similar group parties or functions, which are expressly prohibited. Use of the property for such purposes may result in immediate eviction without refund.

Payment: The balance of rent is due 30 days before your arrival date. Reservations made fewer than 30 days prior to arrival require full payment at the time of booking.

Occupancy: The maximum number of guests is limited to eight (8) persons. Any other person on the property is the sole responsibility of guest. Guests are not allowed to exceed the occupancy limit disclosed in the booking. People other than those in the guest party set forth in the agreement may not stay overnight in the property (“overnight” as defined by the City of Destin is between 10 pm and 7 am). Failure to observe this prohibition shall result in immediate eviction. Any reservation obtained under false pretenses will be subject to forfeiture of deposit and/or rental money, and the party will not be permitted to check in.

Cancellation: Cancellations made more than 60 days prior to your arrival will receive a refund of any advance payments minus a 3% credit card processing fee which is nonrefundable. Cancellations made between 30 and 60 days of the check-in date will receive a 50% refund minus the credit card processing fee. Cancellations made within 30 days of check-in are not eligible for a refund.

PLEASE NOTE! Summer stays after Memorial Day and through August are Saturday to Saturday only. If you make a 7-day reservation beginning on a day other than Saturday, your reservation will be cancelled and we will refund your payment minus the 3% credit card fee which is nonrefundable. If you have any questions, please ask before making your reservation.

Prearrival Info: We will email you prearrival information 5-7 days before check-in.

Arrival and Check-in: Check-in is 4 PM local time on your scheduled arrival date. Check-in before 4 PM is not guaranteed. Once we receive full payment and a signed rental agreement, we will send you detailed check-in instructions.

Departure and Check-out: Check-out is 10 AM local time on your scheduled departure date. Check-out is strictly at 10:00 AM. We will provide you with check-out procedures in advance of your arrival.

No Pets: Pets are not permitted except service animals. Under federal law, service animals are those trained to perform tasks for people with disabilities. Dogs, pets, and other animals whose sole function is to provide comfort, companionship, or emotional support do not qualify as service animals and are not permitted. Failure to observe this prohibition shall result in immediate eviction. Upon departure, if the cleaning company detects any evidence of a pet, you will be charged an additional cleaning fee of $500 to the credit card on file.

No Smoking or Open Flame: No smoking is allowed inside the property. No candles or open flame of any kind are allowed inside the property. Upon departure, if the cleaning company detects any evidence of smoking and/or open flames, you will be charged an additional cleaning fee of $500 to the credit card on file.

Property Security: For the security of both the guests and owner, the property contains a doorbell camera and a security camera above the garage door that records the entrance of the house. There are no video cameras within the house. You expressly agree to the doorbell and security camera and the recordings it may make. Blocking, tampering with, or damaging security cameras is grounds for immediate termination of this lease. Guests will be asked to vacate immediately with no refund.

Property Furnishings: You agree to return all furniture items in a similar good condition as it was prior to the beginning of the lease term.

Golf Cart: A golf cart is provided for your use during your stay at the property. Only licensed drivers at least 16 years of age may drive the golf cart. Under no circumstances should children drive the golf cart. If an underage driver is caught driving the golf cart, you will lose golf cart access for the remainder of the stay. Use the golf cart at your own risk. You will be responsible for all damage to the golf cart. Do not allow anyone other than a listed guest to drive the golf cart. You agree to indemnify and hold owner harmless for any damage you may do to yourself, others, or any property while using the golf cart. When not in use, please store the golf cart in the garage. Upon checkout, leave the key to the golf cart in the ignition in the off position. There will be a $100 fee for any lost golf cart keys.

Community Rules: You agree to abide by all rules governing Destiny East. The rules will be emailed to you separately and are also posted inside the property. These rules and regulations are intended to ensure the safe enjoyment of the amenities, roads and homes by owners and guests; protect the value of our community; and ensure fair and objective treatment for everyone living in or visiting our community. You agree to read and abide by these rules and understand there are fees associated with violating these rules. You are responsible for any fines assessed for violations incurred by your and/or your guests.

Destiny East Amenities: Destiny East has common area amenities including two pools, a hot tub, tennis, pickleball and basketball courts, a fitness center, a playground, and a grill/cabana area. Use these amenities at your own risk. You agree to indemnify and hold owner harmless for any damage you may cause to the amenities or property.

A wristband is required to use these amenities. You will be provided eight (8) wristbands. Please return wristbands prior to your departure. You will be charged $100 for each missing wristband.

Arrival Inspections + Damages: Please complete an arrival inspection on your day of arrival and report any broken items, damage or issues to us immediately. Any damages that occur during your stay must be reported immediately to us. In the event that damage occurs to the property, whether reported by you or found after departure, the cost of repair and/or replacement will be charged to the you. If the amount of repair and/or replacement exceeds the warranty amount, you will be responsible for any additional costs. Additional costs for repair or replacement will be charged to the credit card on file.

Cleaning Fee: A cleaning fee of $350 is required per stay.

Utilities: The cost of normal utilities usage is included with your stay.

Maintenance / Repairs: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. We have an excellent maintenance team that will correct problems as soon as possible. Authorized personnel may enter the premises during business hours for purposes connected with repairs, care, or maintenance of the premises. Expect lawn care personnel on property once a week.

Access: Guest shall allow owner access to the property for purposes of repair and inspection. Owner shall exercise this right of access in a reasonable manner.

Parking: Parking is limited to 3 cars. You must park in designated parking areas only. Overnight (1 am - 5 am) parking in the street is prohibited. Do not block the sidewalk between 10 am and dark or park on the grass at any time.

Quiet Hours: No parties. Guests should not create excessive noise at a level that disturbs neighbors. Code-enforced neighborhood quiet hours are from 10:00 p.m. – 7:00 a.m. Sunday through Thursday, and 11:00 p.m. to 7:00 a.m. Friday and Saturday.

No Daily Housekeeping: There is no daily housekeeping service. While linens and bath towels are included with the property, daily maid service is not included in the rental rate.

Garbage: All garbage must be stowed in the proper garbage or recycling bins located in the garage. Garbage pickup occurs on Tuesday (garbage and recycling) and Friday (garbage only). Guests are responsible for placing the bins at the curb after 5:00 p.m. the day prior to pickup and moving them back into the garage by midnight the day of pickup. Bins visible outside of these times will result in the resort imposing a fine that will be the responsibility of the guest.

Severe Weather/Hurricanes/Tropical Storms: There are no refunds for severe weather including hurricanes, hurricane evacuations, and tropical storms. It is highly recommended, but not required, that you purchase travel insurance. It is up to you to purchase the insurance.

Travel Insurance Provided by TRAVEL GUARD: Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp). Damage Deposit: A damage deposit of $500 is collected in the rental rate. This refundable $500 fee will be used to cover damages incurred during your stay. If no damages are incurred, this fee will be refunded via your original payment method within 5-7 days. If damages exceed this amount, by entering into this Agreement and occupying the Property, the Guest specifically authorizes the Owner to collect any expenses or damages incurred resulting from the intentional or reckless damage, extraordinary cleaning requirements, or theft of any property from the unit. The booking Guest shall be deemed the responsible party for any and all such expenses, damages, extraordinary cleaning or theft resulting from the actions of any person in or occupying the rental property during the Guest’s stay.

Insurance: You are expressly excluded from any insurance policy held by us. You understand that it is suggested that you carry renter's insurance to cover your personal belongings.

Conditions Beyond Our Control: We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, ice storm, severe weather, inclement weather, ferry boat cancellation, loss of electricity, or loss of water. There will be no refund in these circumstances. We recommend you purchase travel insurance prior to arrival.

Criminal Activity: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.

Indemnification: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.

Governing Law: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.

Severability: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.

Falsified Reservations: If you provides false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have a right to report the fraud to appropriate authorities.

Acknowledgement: You have read and agreed to the terms and conditions of this agreement including the vacation rental property rules, community rules, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only.
