The Redfish Reef Vacation Rental Agreement

This is your short-term vacation rental agreement. This agreement outlines everything you need to know about our rental policies for our property. Our goal is to ensure that your stay at our property is wonderful and meets all of your expectations. Rental Agreement: This Agreement constitutes a contract between the Guest (you, your) and Dixieland Properties LLC; Bruce & Tamara Joiner, the owners (us, we, our) of the Vacation Rental Property at 124 Reef Drive Port St. Joe Florida known as Redfish Reef. By signing this agreement, you and your guests are agreeing to all terms and conditions listed in the rental agreement. Your vacation rental is a transient rental under Florida state law. This means that your tenancy is temporary for the stated time period only. At no time is the property to be sublet or assigned to another individual. Please do not make any repairs, alterations, or improvements in or about the property without the owner's pre-approved permission.

Family Rental: We are serious about maintaining a family atmosphere for the quiet enjoyment of all our guests. We will rent to family groups, married couples, and responsible adults over the age of 25 (proof of age is required). The total number of persons allowed in the home at any time is restricted to 10 people. No house parties or pets are allowed. Any violators will be evicted without a refund as well as a loss of the damage deposit.

Arrival and Check-in: Check-in is 4 PM EST on your scheduled arrival date. Check-in before 4 PM is not guaranteed. Once we receive full payment and a signed rental agreement, we will send you detailed check-in instructions.

Departure and Check-out: Check-out is 10 AM EST on your scheduled departure date. Check-out is strictly at 10:00 AM. We will provide you with check-out procedures in advance of your arrival.

Confirmation of Reservation: Your reservation is confirmed when we receive your electronically signed rental agreement and an advance payment equal to 50% of the rental rate. You will receive a reservation confirmation from us. The name on this agreement must be an adult who is at least 25 years old and will be the responsible party for the reservation and all rental obligations.

Payment: An advance payment equal to 50% of the rental rate is required at the time of booking. The advance payment will be applied toward the rent. We will hold reservations without money for 3 days. Please make payments via personal checks, PayPal (friends/family), or Venmo with no additional handling fees. If you prefer to pay by debit or credit card there is a 4% handling fee. The advance payment is not a damage deposit. The balance of rent is due 60 days before your arrival date. Reservations made less than 60 days prior to arrival require full payment at the time of booking.

Security Deposit: A $500.00 security deposit is required. If damage exceeds the security deposit, you agree to pay any and all damage charges above the security deposit. The property is inspected before and after every tenancy. While you are here, we ask for your cooperation in reporting any damage to Tamara Joiner at 478-447-3804 or Bruce Joiner at 478-447-3803. Your security deposit will be fully refunded within (10) days after your departure, providing the following provisions were met:

  1. No smoking, vaping, or open flame (candles) are permitted inside the home.
  2. No damage to the property or its contents (linens/towels included), beyond normal wear.
  3. All garbage from in the house and around the pool is placed in 1 of the 2 large trash containers outside.
  4. The home is left in a neat condition and furniture is not rearranged (a min. $50.00 charge if extra cleaning is required)
  5. Dirty dishes are placed in the dishwasher and the dishwasher is set to run before you leave.
  6. All used/dirty bath towels are placed in the bathroom.
  7. No items are missing from the home; all windows/doors were closed and LOCKED.
  8. There were no violations of the rental policy.

No Daily Housekeeping: There is no daily housekeeping service. While linens and bath towels are included with the property, daily maid service is not included in the rental rate. We do not permit towels, blankets, or linens to be taken from the home and/or used on the beach. Damages will be assessed for any linens/towels that are missing and/or have been misused. We suggest that you bring beach towels for your enjoyment of the beach. Guests will need to provide their own paper items and cleaning supplies. An initial set-up of trash liners, paper towels, toilet paper, and facial soap is provided. Extra items needed are the responsibility of the guest.

Cancellation: Cancellations made more than 60 days prior to your arrival will receive a total refund of any advance payments less a $150 cancellation fee.

Cancellations made within 60 days of the check-in date will receive no refund and you will forfeit any money paid in advance.

Minimum Stay: A 4-night minimum stay is required unless approved by the owners.

Maximum Occupancy: The maximum number of guests is 10 (babies in cribs not included). If you are found in breach of this contract, you may be evicted and no money will be refunded. Only people who have registered with us as a guests may stay overnight on the property.

Getting Here: The confirmation email will state the timeframe in which we will send you details about the property, including how to access the property, check-out procedures, community rules, and names/phone numbers of emergency contacts.

Arrival Inspections + Damages: Please complete an arrival inspection on your day of arrival and report any broken items, damage or issues to us immediately. Any damages that occur during your stay must be reported immediately to us. In the event that damage occurs to the property, whether reported by you or found after departure, the cost of repair and/or replacement will be deducted from the deposit. If the amount of repair and/or replacement exceeds the deposit amount, you will be responsible for any additional costs.

Maintenance / Repairs: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. We have an excellent maintenance team that corrects problems as soon as possible. Authorized personnel may enter the premises during business hours for purposes connected with repairs, care, or maintenance of the premises. Expect lawn care personnel on the property once a week.

Parking: Parking is spacious with 4 parking spaces onsite and additional space for trailers or boats.

Pets: Non-shedding dogs, weighing 20 lbs or less, may be considered with owner approval.

Conditions Beyond Our Control: We are not liable for events beyond our control that interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, pandemics, hurricanes, tropical storms, severe weather, inclement weather, loss of electricity, or loss of water. There will be no refund in these circumstances.

It is highly recommended, but not required, that you purchase travel insurance. It is up to you to purchase the insurance. Coverage is available for health and weather-related problems www.insuremytrip.com provides the most positions and you can order online to purchase this in your name.

Indemnification: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.

Governing Law: This agreement shall be governed, construed, and interpreted under the Laws of the State of Florida and Gulf County.

Falsified Reservations: If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have the right to report the fraud to the appropriate authorities.

Acknowledgment: You have read and agreed to the terms and conditions of this agreement, including the vacation rental property rules, community rules, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only.
