RENTAL AGREEMENT - TERMS AND CONDITIONS
This is our home and we Love It! Please treat our home with care and respect. Never leave doors or windows open while the A/C is running. We thank you for your cooperation!
- RELEASE AND INDEMNIFICATION:
- Tenant fully releases, and agrees to indemnify and hold harmless, the Owner and the Owner’s agents, representatives, principals, members, employees, officers, and directors, from and against any loss, damage or expense, including reasonable attorney’s fees, incurred or suffered by or threatened against the Owner or any of the foregoing in connection with or as a result of any claim for personal injury, property damage, property loss or theft or otherwise brought by or on behalf of Tenant, other occupants or invitees of Tenant or any third party, person, firm or corporation as a result of or related to or in connection with the Tenant’s rental of the Vacation Home. Owner cannot be responsible for any of the Tenant’s (or other occupants) valuables, cash, or personal property during the rental term or thereafter left at the rental unit.
- By agreeing and accepting the terms of this Agreement, Tenant agrees to be financially responsible for all damages, theft, and excessive cleaning, as well as legal fees incurred by Owner, as a result of litigation to collect for damages. Please call 850-602-3793 immediately if something is accidentally broken or if something is found to be missing so it can be replaced as soon as possible.

- No Smoking inside the property or balcony.
- No Occupancy exceeding maximum (12)
- No Possession, provision or use of illegal drugs.
- No Possession, provision, or use of alcoholic beverages by or to persons under the age of 21.
- No Causing damage to the duplex, amenities, or any neighboring properties.
- No large parties.
- DAMAGE/RESERVATION DEPOSIT- If damages exceeding the amount of the deposit occur during your stay, agrees to pay owner for costs to cover all damages. The deposit is fully refundable within fourteen (14) days of departure, provided the following provisions are met.
- No damage done to the unit or its contents, beyond normal wear and tear.
- No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
- All debris, rubbish and discards are placed in the containers and soiled dishes are cleaned and stored in the proper places.
- No linens are lost or damaged.
- No fireworks or weapons of any type are brought into the condo.
- The guest(s) are not evicted by the owner (or representative of the owner), the local law enforcement or security company employed by the Complex.
- WHAT WE SUPPLY: The duplex is fully furnished and includes bedspreads, linens, blankets, pillows, towels, equipped kitchen (refrigerator, microwave and cooktop). Our duplex is re-provisioned each year at the beginning of the rental season; however, we make no guaranty that all items will remain in the duplex during your rental. Please contact us if you feel something is missing that should be there.
- WHAT YOU SHOULD BRING: Please bring your personal toiletry items including hair dryers, beach towels, food, trash bags, spices, and any other consumables. One round of toilet paper, paper towel, hand soap, body soap, dish soap, trash bag, dishwashing detergent, and laundry detergent is provided by the housekeeping service; please bring extras.
CLEANING: The House will be cleaned before your arrival and after your departure. There is no daily cleaning service unless requested by you and additional fee paid. You are required to leave the Property in the same general condition in which you received it, with all dishes and kitchen items cleaned and stored and all trash removed from the home and placed in the trash cans provided.
MAINTENANCE:
- ISSUES: Report all maintenance issues promptly by calling Dee at 850-602-3793. Just as might occur at your own well-maintained home, mechanical failures and other breakdowns could occur. Every effort will be made to correct the situation; however, no refunds or rate adjustments will be made for mechanical failures.
- DAMAGE: Report any damage or breakage upon occurrence by calling 850-602-3793, so the matter can be settled before departure. Damages found by inspection crews upon departure will be billed and full payment for repairs will be collected.
- NO GUARANTEES: Working condition of air conditioners, cable, internet service, TVs, VCRs, DVDs, appliances, etc., are NOT guaranteed. NO REFUNDS or rate adjustments will be made for mechanical failures and malfunctioning equipment. Although all attempts will be made to correct the situation, some breakdowns cannot be prevented or repaired during your occupancy.
- MAINTENANCE VISITS: Maintenance technicians and vendors may access the property for purposes of repairing previously reported issues.
- CONSTRUCTION: The continued growth of our area is evidenced by new construction that may near existing vacation rental properties with potential noise and/or traffic. You may reserve a property at a time when no construction is nearby, but construction could begin prior to your arrival. We regret any inconvenience but cannot control these situations. Refunds or relocations cannot be considered.
- MISSING ITEMS ARE CONSIDERED DAMAGED: All furniture, fixtures, décor, appliances, linens, decorations, blankets, pillows, etc. are property of the owner. Blood on the sheets and/or mattresses are also considered irreparable damage that will result in charge. We have plastic and cloth mattress covers on our mattresses. Please do NOT remove them.
- OWNER’S RIGHT OF ENTRY AND RIGHT TO INSPECTION: Owner and owner’s agents representatives, principals, members, employees, officers, and directors reserve the right to enter and inspect the property with no notice at any time during the Tenant’s rental term.
- SOFA SLEEPERS/FUTON & BUNK BEDS: Sofa sleepers/Futons & Bunk Beds are best suited for children and may be uncomfortable for adults.
- CANCELLATIONS: Cancellations that are made more than 60 days prior to arrival date will incur no penalty. Cancellations made within 31-60 days of the arrival date will be charged a $150 administrative fee. Cancellations made 0-30 days prior to arrival date will forfeit the full advance payment and damage/reservation deposit. NO REFUNDS are issued for cancellations or early departure due to personal circumstances inside the cancellation date range.
- NO REFUNDS due to inclement weather; travel insurance is offered at the time of booking if you choose to purchase it.
- NO REFUNDS will be issued for unavailable amenities.
- FURNISHINGS: Décor, style, color schemes and inventory may vary. Some internet photos may differ due to updates or changes. We do our very best to keep our photos updated.
- LOST AND FOUND: Please call us at 972-393-5354 to report the item(s) left behind in our property. While we are not responsible for items left in our property, we do care about the return of your belongings. If your items are located, you will receive a call from UPS requesting shipping information and payment.
- PROHIBITIONS: All of the following are strictly prohibited, and violating any of these prohibitions will result in immediate eviction and forfeiture of all rent:
- 1. No Firearms and/or fireworks on the property.
- 2. No Excessive noise before 8AM or after 9PM.
- 3. No Violation of local, state, or federal law.
- 4. No Groups comprised of parties under age of 25. We do not rent to vacationing students without an accompanying responsible parent. NO EXCEPTIONS!
- 5. No Pets are allowed.
- 6. NO SMOKING INSIDE OR ON BALCONIES

- *** Other Important Info for your Stay***
- Refrigerator: Check-in day was most likely a check-out day for another guest. This means the fridge has been open for long periods of time today and cannot handle an overload of warm foods. Please leave items that do not need immediate refrigeration in the pantry or in your coolers and avoid overfilling the refrigerator. It can take up to 24 hours for the fridge to cool down when filled with room temperature food.
- Air Conditioner: PLEASE DO NOT SET BELOW 70 DEGREES - On very hot days (90+ degrees) please be aware that the A/C units will NOT cool below 20 degrees difference for the outside temperature. DO NOT set the temperature to a lower setting as the unit will freeze up and you could cause serious damage to the A/C unit! Turn on ceiling fans, lower blinds, and keep doors and windows closed.
- Toilets and Drains: Please do not use the toilets or drains for the following items as it will cause damage and clog toilets and drains: No oil, sand, cloth, glass, wood, plastic, grease, egg shells, seafood shells, sanitary napkins, diapers, diaper wipes, personal hygiene products, socks, metal, paint, sand, rags. If a Plumber call is needed due to the above, you will be charged.
TRASH PICKUP: Trash pick up is on Wednesday morning. IMPORTANT: take the trash cans to the street on Tuesday evening. Excessive trash left in the bins for the housekeeping service to deal with will result in a charge to you!
Miscellaneous:
- Please do not rearrange furniture.
- If this property is listed for sale during your stay, we will make every effort to have showings only between guests on check in/out days. In the event that is not possible, we reserve the right to allow showings during your stay and will do so minimally while being most respectful to you and your vacation.
