SHORT TERM RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between Harvest Recreations (“Cabin Owners”) and Guest. This rental agreement is considered a legal and binding contract and therefore gives Harvest Recreations the right to collect payment for damages, missing items, and excessive cleaning upon guest’s departure. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

  1. Guest: Guest verifies that they are: (A) at least 25 years of age with a maximum of 6 guests; or (B) at least 21 years of age and married with a maximum of 2 adults. Guest agrees not to exceed the maximum occupancy. Guest confirms they will be an overnight guest in the cabin along with the number of persons specified on the reservation. Only these guests are permitted in the cabin.
  2. Rental Period. The rental begins after 4:00 p.m. on the Check-in Date and ends at 10:00 a.m. on the Checkout Date. After 10:00 am Guest will be charged $25 plus $25 for every half hour that Guest remains in the cabin as housekeeping cannot begin their work. This amount is due and payable to the cleaning staff upon their arrival. Sorry, no exceptions to check-in and check-out times.
  3. Minimum Stay: This property requires a 2 night minimum stay. Longer minimum stays will be required during most holiday periods. If guest elects to stay less than the minimum nights, guest will be charged for the minimum number of nights.
  4. Rental Rate and Fees
    • Deposit: 25% of the rental amount is due at the time of the reservation. Payment in full of the balance due, including taxes and fees shall be paid 30 days prior to the Check-in date. If Check-In is less than 30 days at time of reservation, the entire rental amount is due.
    • If the premises appear dirty or damaged upon Check-in, Guest shall inform Harvest Recreations immediately. Guest accepts responsibility for any issues found on inspection after departure that were not reported.
    • Cleaning and Hot Tub Fee: There will be a cleaning fee per reservation. This includes draining, cleaning, sanitizing, and refilling the hot tub prior to each Guest arrival in accordance with the Sevier County Health Department regulations.
    • Accidental Rental Damage Insurance: In lieu of a large security deposit, all Guests will pay a non-refundable fee for accidental damage insurance, which is included with the rental quote. This insurance will cover accidental damage caused by guest(s) during the stay for up to $1000 in damages. Guest agrees to be responsible for any repair/replacement costs above and beyond the insurance limit of $1000.
  1. Cancellation Policy: Full refund if cancelled more than 30 days before arrival. Rental amounts, taxes, and fees are non-refundable within 30 days of arrival. Guest may change an existing reservation if more than 14 days prior to arrival for a $75 change fee, only the paid rental amount may be applied to a changed reservation. New reservation dates must be selected at the time of changing an existing reservation. No refunds will be given for early departure or no shows. NOTE: Any service fee paid to a Booking Site will be forfeited if a reservation is cancelled. Contact Booking Site for additional information.
  2. Insurance: We recommend all guests purchase traveler insurance. Guest is responsible for the entire booking once the reservation is made and within 30 days of arrival.
  1. SMOKING: Smoking is NOT If evidence of smoking is detected inside our cabin or on the decks, it will be considered a material breach of this agreement and Guest will be charged an additional cleaning fee of a minimum $250.
  1. PETS: Pets are NOT allowed, sorry, no exceptions. If evidence of a pet is found at any time during or after the stay it will be considered a material breach of this agreement and Guest will be charged a $250 fee plus cost of repairs for any damage caused by the pet.
  1. HVAC System: The cabin is equipped with energy efficient, smart technology systems that automatically adjusts to a comfortable temperature and humidity level based on weather conditions within a range of 70 F in cold weather, to 77 F in warm weather. Thermostat will be visible but enclosed in plastic casing and not accessible. Guest agrees not to touch the thermostat settings or plastic casing! Guest agrees to contact Harvest Recreations to request a change to the cabin temperature. Guest will be charged a minimum of $200 for repairs for damage to thermostat or plastic casing.
  1. Property:
    • Our cabin is in the Legacy Mountain Resort off Upper Middle Creek Rd near traffic light #8 in the Pigeon Forge / Gatlinburg / Sevierville Tennessee area.
    • Our cabin is fully furnished and includes the following appliances: Full size refrigerator, Microwave Oven, Full size oven/stove top, Washer and Dryer, dishwasher, Crock Pot, Coffee Maker, George Forman Grill, Knife Set, Kitchen Utensils, Bread Maker, Skillet, Frying pan, Pizza cooker, dishes, glassware, eating utensils, pots and pans, flashlights & nightlights, table linens, bed linens, hairdryers, bath towels & wash cloths.
    • We cannot guarantee that all amenities, appliances, and/or equipment will be in working order 100% of the time. If problems with amenities occur, please contact Harvest Recreations, we will respond as quickly as possible to make repairs and restore amenities. We cannot refund any monies due to such issues.
    • A starter supply of dish soap, paper towels, bath soaps, shampoos, and toilet paper will be provided. Guests will need to bring extra for longer stays.
    • Guest agrees not to rearrange the furniture.
    • Guest agrees to keep our cabin and all its furnishings clean and in good order. Guest agrees to use furnishings and appliances for their intended uses only. Guest is responsible for any damage to appliances, furnishings, and premises due to misuse.
    • Guest accepts responsibility for any issues found on inspection after departure that were not reported. Guest agrees to leave the property in the condition that it was in upon check-in.
  1. Hot Tub:
    • Use of the hot tub is at guests own risk. Cabin Owners will not be held responsible for injuries sustained by guest(s) when using the hot tub, and guest(s) will indemnify cabin owners for any actions resulting from injuries to guests.
    • When using the hot tub, remember there is certain health risks associated with this facility. Drink lots of water while in the hot tub to prevent dehydration and limit time in the tub to 15 minutes.
    • No children under the age of 16 permitted in hot tubs at any time without adult supervision. Children under the age of 3 strictly prohibited.
    • Pregnant women should not use the hot tub
    • Our housekeepers drain, sanitize, refill and replenish chemicals in the hot tub prior to arrival; therefore, it will not be warm until later that evening.
    • No food or alcohol allowed in the hot tub. No soaps or bath products allowed in the hot tub. Guest will be charged an excessive cleaning fee of $150 if evidence of any of these type items are found in the hot tub.
    • DO NOT STAND OR SIT ON THE HOT TUB COVER. Hot tub cover is for insulation purposes and is not designed to support a person or persons. It will break and Guest will be charged $400 to $600 for replacement. When not using the hot tub, leave the cover on so hot tub will stay warm.
    • The water level in the Hot Tub must be maintained to ensure optimal operation. If the water level drops due to excessive splashing and/or rough playing that results in damage to the hot tub motor Guest will be charged for repairs.
    • The guest understands that the hot tub is strictly an amenity and that the use of this amenity is not guaranteed under the terms of the rental agreement. Any interruption or non-availability of the use of the hot tub will not violate any terms of the rental agreement.
  2. Legacy Mountain Resort Amenities Center:
    • The Legacy Mountain Resort Amenities Center is owners by the Legacy Mountain HOA and is located at the top of the mountain. There is a sauna, stream room, exercise equipment and a seasonal swimming pool.
    • Guests may use the Legacy Mountain Amenities Center and assume all associated risk.
    • No lifeguard on duty. Do not swim alone. Children under age 18 must have adult supervision at the amenities center.
    • Neither cabin owners or HOA will not be held responsible for the injuries sustained by guests(s) when using the swimming pool and/or amenities center, and the guests(s) will indemnify the cabin owners and/or the HOA for any actions resulting from injuries to guest(s).
    • An access code will be provided at check-in. Guest agrees to keep all gates and doors to the amenities center closed at all times to prevent unauthorized access.
    • Guest understands that the swimming pool and amenities center is strictly an amenity and that the use of these amenities is not guaranteed under the terms of this rental agreement. Any interruption or non-availability of the use of these amenities will not violate any terms of the lease.
  3. JUKEBOX: Our cabin has an antique style CD Jukebox. Guest is encouraged to use it and enjoy it! It is a lot of fun and has a variety of music we hope will suit everyone! This Jukebox is in perfect condition with no cracks, scratches, or blemishes. Guest agrees to be extra cautious around this valuable piece, please no horseplay or roughhousing near Jukebox. Guest will be responsible for any damage to Jukebox including cracks and scratches.
  4. No Student Groups or House Parties of Any Kind! Cabin occupancy is limited to the number of guests in the reservation at all times. If guests are found to be having a party in the cabin, everyone will be asked to vacate the premises. No refunds will be given.
  5. NOISE: Quiet time in the development is between 11pm and 7am. Please be considerate of the other neighboring cabins during these hours. Sound travels far on the outside balconies. There will be a $50 fee if security is called to investigate the first noise complaint and $100 thereafter. No refunds will be given if guest is evicted from the cabin for causing a disturbance. Guests may call local authorities in the event neighboring cabins are disturbing the peace.
  6. USE OF ILLEGAL DRUGS OR POSSESSION OF ILLEGAL FIREARMS IS PROHIBITED. IF GUESTS ARE FOUND TO HAVE EITHER IN THEIR POSSESSION, GUEST WILL BE ASKED TO LEAVE WITH NO MONEY REFUNDED AND COULD FACE LOCAL PROSECUTION!
  7. Linens: Linens are provided for guest use during the stay only, bed sheets, blankets, pillows, and one (1) bath towel per Registered Guest. Washer and Dryer are available in the cabin. Please do not wash linens with personal items. If the linens are damaged due to personal items bleeding on to them, Guest may be liable for the damage.
  8. Parking: Parking is limited to 2 vehicles. Vehicles are to be parked in front of the cabin. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.
  9. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from our cabin.
  10. Access: Guest shall allow Harvest Recreations or designated representative access to the property for purposes of repair, inspection or other extenuating circumstances. Harvest Recreations shall exercise this right of access in a reasonable manner.
  11. Fireplace: The fireplace is a non-vented electric firebox. Please do not throw any paper or other combustible materials in the fireplace.
  12. Water and Septic: The cabin is on a well and septic systems. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products, paper towels, etc. should be flushed at any time.
  13. Trash: All trash must be disposed of properly so as discourage investigation by wildlife in the area. Heavy metal receptacles are located outside the cabin. Please place trash in the receptacles and ensure the latch is closed! Any trash found outside the receptacle will result in a fine of $50 to Guest. Please do not throw trash or any other objects off the balconies. Please remove all trash from the cabin upon checkout and place in the metal receptacles.
  14. Lost and Found. Harvest Recreations is not responsible for guest’s items that are lost or stolen while in the cabin. Guest will notify Harvest Recreations within 24 hours of check-out if there are lost items they would like returned. There will be a $50 search fee paid in advance. If housekeeping is able to find items lost or left behind, guest may choose to have these items returned at guest’s expense for postage and handling.
  15. Departure.
    • Check-out is at 10:00 am to allow housekeeping time to prepare for the next guest. A late checkout fee of $25 will apply after 10am, and each half hour thereafter that Guest remains in the cabin.
    • Upon departure:
      • Please clean all dishes and kitchen appliances used during the stay, and put them away.
      • Ensure the dishwasher and sink are emptied.
      • Turn off all faucets, lights, Televisions, the stereo and the jukebox.
      • Ensure all doors and windows are closed and locked.
      • Empty all trash containers and place garbage in the metal receptacle outside the cabin. Guest may be charged additional fees if excessive cleaning is required inside the cabin or on the grounds surrounding the cabin, including below the cabin.
      • Double check that no personal articles are left behind, we cannot guarantee their return after departure.
      • Turn on the porch light and one interior lamp.
      • Ensure cabin door is locked upon departure.
  16. Storms: We are not responsible for weather conditions or other acts of nature.
    • No refunds will be given for winter storms. Most roads in the area are well maintained. However, Mountain roads can be curvy and steep, four wheel drive and/or chains are recommended during the snow months.
    • No refunds will be given due to road conditions.
    • No refunds will be given due to any storm, hurricane, severe weather conditions or acts of nature.
  17. Attorney Fees and Choice of Law. In the event Harvest Recreations should elect to file suit to collect or otherwise enforce the terms or provisions of this agreement, guest shall be jointly and severally liable for payment of all costs of suit including, but not necessarily limited to court costs and attorney fees. All suits filed in relation to this agreement shall be filed in a court of competent jurisdiction in Sevier County, Tennessee.

Our cabin is privately owned; we are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. Harvest Recreations is not responsible for the loss of personal belongings or valuables of the Guest. By accepting this reservation, it is agreed that Guest are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. Guest agrees to hold Harvest Recreations/Owners harmless against any claim for damage and/or injury due to guests act or act of neglect.

Guest agrees they have read and agree to this Rental Agreement in its entirety prior to requesting a reservation.
