The MAXIMUM total number of guests is Eight (8). The MAXIMUM number of adults (over 18) is restricted to four (4).

The guests on this list are the only guests permitted to stay overnight during your rental period. You are responsible for all guests on this list. You are also responsible for any visiting day guests entering the home. Any violation to the maximum guest count, (adult or total), will result in an immediate termination of your vacation and forfeiture of the entire rental payment.

"These Are The Days" Vacation Rental Agreement

About the cottage: This is our own family vacation home that we enjoy sharing with guests. We appreciate your care and consideration of our property and ask that you leave everything in the same condition in which you found it. Our goal is to ensure that your stay at our property is wonderful and meets all of your expectations. If ever there is a problem, we ask that you contact us within 24 hours and we will work to get it taken care of immediately. We want your stay to be fabulous!

Rental Agreement: This Agreement (agreement) constitutes a contract between the Guest (you, your) and Owner (us, we, our) of the Vacation Rental Property (property). By signing this agreement, you and your guests are agreeing to all terms and conditions listed in the rental agreement. Your vacation rental is a transient rental under state law. This means that your tenancy is temporary and for the stated time period only. At no time is the property to be sublet or assigned to another individual. Please do not make any repairs, alterations, or improvements in or about the property.

Confirmation of Reservation: Your reservation is confirmed when we receive your electronically signed Rental Agreement, guest list, copy of DRIVERS LICENSE and an advance payment equal to 50% of the rental rate (or full payment if within 60 days of your stay). The name on this agreement must be an adult who is at least 25 years old, and will be the responsible party for the reservation and all rental obligations. The rental agreement cannot be transferred to another party. Absolutely no exceptions for any reason. We strongly recommend the purchase of trip insurance.

Guest List and Drivers License: We will ask that you provide a list of all guests and their ages along with a copy of your Drivers License via email within 48 hours of your reservation request. Failure to provide this list will result in the cancellation of your reservation. Only guests listed are permitted to stay overnight during your rental period. Any violation to the maximum guest count will result in an immediate termination of your stay and forfeiture of your payment. You are responsible for all guests on the list. Should your guest list change, please notify us via email prior to your arrival.

Payment: An advance payment equal to 50% of the rental rate is required at the time of booking. The advance payment will be applied toward the rent. Please make payments via credit card or personal checks. The advance payment is not a damage deposit. The balance of rent is due 60 days before your arrival date. Reservations made less than 60 days prior to arrival require full payment at the time of booking.

Security Deposit: In lieu of a security deposit we put a mandatory $69 Damage Protection Policy in place. You are responsible for any and all damages that occur to the property or its contents by you or any other member of your group, individually or collectively, while you are the registered occupant of the property.

ivacationonline.com Damage Protection Policy: Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

The purchase of the insurance does require you to follow the check-out procedures list posted in the cottage. Failure to abide by checkout procedures will result in a charge for additional cleaning staff needs at a rate of $100 per hour.

Credit Card Authorization: As the registered guest you understand a consent to the use of the credit card on file provided by you at the time of the reservation request. You understand that by clicking the check box on the term and conditions page of the lease application that you have read the terms and conditions of this property and are bound by this agreement. The credit card authorization cannot be revoked and will not terminate until 90 days after the lease period. Charges that may be applied to your credit card on file include damages beyond what is covered by the warranty protection policy, including but not limited to late check-out fees, parking violation fines, missing bicycles, trash collection fees and failure to abide by checkout procedures.

Cancellation: Cancellations made more than 30 days prior to your arrival will receive a total refund of payments made, less a 3% credit card processing fee.

Cancellations made within 30 days of the check-in date will receive NO REFUND and you will forfeit any money paid in advance. We strongly recommend trip insurance.

Severe Weather/Hurricanes/Tropical Storms Cancellation: There are no refunds for severe weather including hurricanes, hurricane evacuations, and tropical storms. It is highly recommended, but not required, that you purchase travel insurance. It is up to you to purchase the insurance, it is not our responsibility.

COVID-19 Cancellation: We cannot and will not serve as your travel insurance provider. Any cancellations due to COVID-19 will only be refunded if we are not permitted to rent by law during your reservation. No exceptions will be made. You must take the responsibility of purchasing travel insurance that will cover a cancellation due to pandemic and/or COVID-19.

Travel Insurance Provided by TRAVEL GUARD: Tropical storms, hurricanes and other unexpected events may cause travelers to delay, interrupt or even cancel their trips completely. Insurance: You are expressly excluded from any insurance policy held by us. You understand that it is suggested that you carry renter's insurance to cover your personal belongings.

Maximum Occupancy: The maximum number of guests is 8 (4 adults max) If you are found in breach of this contract, you will be removed from the property, your stay terminated, and no money will be refunded. Only people who have registered with us as a guest may stay overnight on the property.

Getting Here: One week prior to your arrival, you will be sent a welcome letter which will contain additional details about the property, including: how to access the property, check-in/check-out procedures, community rules, and reminders to make your stay easy and fun!

Arrival Inspections: Our cottage has been inspected prior to your arrival to ensure your comfort. Please complete your own arrival inspection on your day of arrival and report any broken items, damage or issues to us immediately. Any damages that occur during your stay must be reported immediately to us. In the event that damage occurs to the property, whether reported by you or found after departure, the cost of repair and/or replacement will be accounted for by the placement of a claim against the damage protection policy. Additional costs for repair or replacement will be charged to the credit card on file.

Arrival and Check-in: Check-in is 4 PM local time on your scheduled arrival date. Please do not attempt to arrive earlier than 4:00 PM as your personalized electronic door lock code will not be active until 4:00 PM. Our cleaning staff needs adequate time to prepare the cottage for your arrival.

Arrival Finds: The cottage is stocked with a small starter supply of the following items for your convenience: a kitchen sponge, a disposable kitchen towel, 1 roll of paper towels, 2 garbage can liners per can, dishwashing liquid, a dishwasher detergent tablet, a laundry soap tablet, 2 rolls of toilet paper per bathroom, and a small bath soap for each bathroom.

Departure and Check-out: Check-out is 10 AM local time on your scheduled departure date. Please be prompt on departure as our cleaning staff needs adequate time to prepare our home for future guests. Check-out procedures can be found on the side of the refrigerator in the cottage. Failure to check out by 10 AM will result in a late checkout charge of $100 per hour after 10 AM. Late checkout charges will be charged to the credit card on file.

Video Doorbell Camera The property utilizes a video doorbell with a motion sensing camera that faces the street and driveway. The doorbell camera is primarily used for crime deterrence and monitoring when the property is vacant. There are no cameras on the interior of the cottage or facing the interior of the cottage. Tampering with the video doorbell in any way is strictly prohibited and may result in termination of your stay without refund.

Maintenance / Repairs: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. We have excellent maintenance contractors who correct problems as soon as possible. Authorized personnel may enter the premises during business hours for purposes connected with repairs, care, or maintenance of the premises. Expect lawn care monthly. Any service call requested by the guest as a result of guest action, misuse or negligence may result in a $100 service fee plus the cost of onsite repairs including parts and labor charged to the guest.

House Rules:

Clipper Cove Good Neighbor Rules/Good Neighbor Policy:

Clipper Cove is a mixed use neighborhood that includes both short-term guests and many year-round residents. Please be considerate of the neighbors with your noise level and activities. We want you to enjoy your stay but not at the expense of the neighbors.

In order to preserve the peaceful atmosphere and aesthetic qualities of our neighborhood, the Clipper Cove Homeowners Association has an established set of rules:

NO PARKING ON THE STREET – This is a citywide ordinance strictly enforced by the City of Destin and the Clipper Cove HOA. Please note that the Clipper Cove HOA employs a roaming towing service. Any vehicles parked in violation of HOA rules will be towed at the vehicle owner’s expense without notice.

You may be fined if any of these rules are broken. Any fines incurred due to failure to comply will be your responsibility.

PLEASE NOTE THAT IF WE ARE NOTIFIED OF FAILURE TO COMPLY WITH THE HOUSE OR NEIGHBORHOOD RULES, THIS WILL RESULT IN TERMINATION OF YOUR CONTRACT, IMMEDIATE REMOVAL AND FORFIETURE OF THE TOTAL RENTAL PAYMENT WITHOUT REFUND.

Parking: Parking is limited to 2 cars. No street parking is allowed. The homeowners association tows improperly parked vehicles and any towing costs or fines will be paid by the vehicle owner. Vehicles improperly parked are subject to towing without notice.

No Pets: We DO NOT allow pets. If a pet is found on the property during your stay, we have the right to ask you to vacate the property immediately with no refund of any kind. Upon departure, if the cleaning company detects any evidence of a pet, additional cleaning fees of no less than $500 will apply.

No Smoking or Open Flame: No smoking is allowed on the property. No candles or open flame of any kind are allowed on the property. Upon departure, if the cleaning staff detects any evidence of smoking and/or open flames, additional fees will apply.

Housekeeping/Cleaning Fee: We want the cottage to be neat and clean upon your arrival and for future guests as well. As such, a cleaning fee has been applied as part of your rental payment. There is no daily housekeeping service. You will be responsible for some light upkeep during your stay and for leaving our home in good and orderly condition at checkout. While bed linens and bath towels are included in your rental, daily maid service is not included in the rental rate. A washer and dryer is provided for your convenience.

Linens/Towels: Although bed, bath and kitchen linens are provided, please BRING YOUR OWN BEACH TOWELS as bed/bath/kitchen linens are not to be removed from the cottage.

Laundry: Please use ONLY “HE” high efficiency laundry detergent in the washing machine. If “HE” is not used, it will damage the machine and a sizable repair fee could be charged to you. Please do not overload the washer or dryer. To reduce the risk of fire, please remove any and all lint from the lint screen in the dryer before each load. When laundering personal items, please shake excess sand from the items outside prior to laundering. Excess sand in the washing machine will cause the drain pump to fail. The cost of repairs including parts and labor due to failure of the drain pump due to excess sand will be charged to the guest.

Trash/Recycling: Trash days are Tuesdays and Fridays with recycling on Tuesdays only. Each bin should be placed out at the curb the night before scheduled pickup. Each can should be positioned so the lid can be lifted from street side as the garbage truck has an automated lift. DO NOT leave trash of any kind outside the bins as the truck will not pick it up. Community rules require that you bring the bins back behind the fence by noon on trash days after pickup. Please put the trash bins out during your stay. If the next guest checks in and the trash containers are full, you will be charged a $50.00 fee.

Tropical Climate and Pests: Guests understand that we, as homeowners, participate in a regular pest control program and make our best effort to hold to an absolute minimum, our guests' interaction with insects, rodents and lizards which are very common in the tropical climate in Florida. Your cleanliness during your stay will also keep encounters to a minimum. Please wipe down kitchen surfaces after all meals and keep food in closed storage containers at all times. Please know that contact with a pest inside or outside our home is not reason for termination of the Rental Agreement nor is it a reason for a refund of guests' payments.

Bicycles: For our guests’ use and enjoyment we provide four (4) beach cruiser bikes. We appreciate your considerate use of an amenity provided to you as our guests. All bikes should be locked by their frames on the bike rack provided at all times when not in use. Any costs incurred to the owner as a result of damage to bicycles during your stay will be charged against your damage deposit. If a bicycle is damaged beyond repair or missing upon guests’ departure, guest will be charged and responsible for the replacement of each missing bike valued at $650 per bicycle. Guest will make payment directly to owner for missing/damaged bikes via credit card within 5 days of receipt of email notice from owner. Bikes should be locked by their frames when not in use. Please obey all local laws when using bicycles provided. Bicycle helmets are recommended and can be purchased or rented locally. Adult supervision of children under 18 is advised.

Outdoor BBQ Gas Grill: The gas grill is provided as a convenience to you for outdoor cooking during your stay. For your personal safety and for fire safety reasons, it should not be moved from its current location, several feet from the rear of the home. If the grill is used in close proximity to the home, the siding will heat and melt, causing damage to the home that you will be responsible for. The propane tank should be turned off after each use.

Beach Flags: FOR YOUR OWN SAFETY: We want you to have the best time possible during your beach vacation. The Gulf of Mexico can produce strong waves and currents. For your safety we ask that you familiarize yourself with the BEACH FLAG WARNING SYSTEM. A flyer demonstrating all beach flag colors and their meanings is noted below and may also be available in our home for your use and reference.

GREEN: Low hazard, calm conditions, exercise caution

YELLOW: Medium hazard, moderate surf and/or currents

RED: High hazard, high surf and extreme currents

PURPLE: Dangerous marine life present

DOUBLE RED: Water closed to public, DO NOT ENTER THE WATER

Conditions Beyond Our Control: We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, ice storm, severe weather, inclement weather, loss of electricity, loss of cable/WiFi, or loss of water or pandemic. There will be no refund in these circumstances. We STRONGLY recommend that you purchase travel insurance prior to arrival.

Criminal Activity: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.

Indemnification: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.

Governing Law: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.

Severability: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.

Falsified Reservations: If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We reserve the right to report the fraud to the appropriate authorities.

WELCOME LETTER: One week prior to your arrival, we will send you our Welcome Letter that contains:

Acknowledgement: You have read and agreed to the terms and conditions of this agreement including the vacation rental property rules, community rules, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only.
