Terms and Conditions

Please print these Terms and Conditions for your records.

The property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease and must be vacated by 10:00 AM local time on the ending date of the lease. This is a Saturday to Saturday Rental. During high season, some units may not be ready by 4 p.m., your patience is appreciated. NO EARLY CHECK INS.

The PREMISES is located at: 372 E. Beach Blvd #9, Gulf Shores, Alabama 36542

Accidental Damages to Rental Property:

Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

  1. a) No damage is done to the unit or its content including the linens, or electronics.
  2. b) No items are missing upon the inventory check. (This includes, but is not limited to, transferring items to other owner units including patio furniture.
  3. c) All debris, garbage and discards are placed in proper containers.
  4. d) All soiled dishes are placed in the dishwasher.
  5. e) There was no exceeding the maximum occupancy of the unit.
  6. f) There was no smoking or evidence of smoking in the designated non-smoking unit.
  7. g) Unit is left in neat condition.

Accidental Damages to Rental Property:

You are responsible for any and all damages that occur to the property or it's contents by you or any other member of your group while you are the registered occupant of the property. The Guest hereby acknowledges and agrees that the Guest may be liable to the Landlord for any loss or damage that the Landlord suffers as a result of the Guest’s use of the Property, and this Liability is not limited to the amount of the Damage Insurance.

Nothing in this Agreement prevents the Landlord from claiming additional compensation from the Guest in the relation to any breach of this Agreement or in relation to any damage to the Property. Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp). SEVERE WEATHER - We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do no warrant refund of rent or deposit.

Hurricane Policy and Tropical Storm Policy: We DO NOT offer any refunds for Hurricanes or Tropical Storms.

ACTS OF GOD: We shall not be liable for events beyond our control which interfere with Your scheduled occupancy, including, but not limited to, Acts of God, acts of governmental agencies, fire, strikes, war, tornado, ice storm, severe weather, inclement weather, ferry boat cancellation, loss of electricity, or loss of water. NO REBATE OR REFUND shall be given in these circumstances. We recommend you purchase Travel Insurance during making your reservation.

ABSOLUTELY NO PETS are permitted in rental units under any circumstances, NO EXCEPTIONS. If any evidence of a pet(s) is found in your unit or on the premises, you will be asked to vacate immediately with no refund of rent and the owner will automatically charge your credit card on file $500 for the cost of a DEEP clean and carpet cleaning of the entire home.

GRILLS: No grills are permitted at this unit. There is a grilling area next to the pool. Local fire regulations prohibit the use of grills on the porches or in the community due to the proximity of the roofs and other units. Please use the charcoal grills at the pool if you would like to grill your food.

COMMUNITY RULES: Guest agree to abide by rules of the community. These may be posted in the unit or at the community pool or office. These rules may change from time to time.

Parking:is limited to a MAXIMUM of 2 vehicle(s) IN THE ASSIGNED COVERED PARKED OF THIS UNIT. Parking passes are located inside the unit. Renters must display parking pass on the rear-view mirror at all times. Failure to display Will result in towing of vehicle at renter's expense. Leave the parking passes inside the unit upon departure. Vehicles are to be parked in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. You will be charged for not leaving the passes at your departure. If you have a oversize vehicle or lifted please alert owner for details on parking details. We have limited parking at Condos These rules must be followed.You will be issued 2 parking passes when you arrive at the unit. ( If you park in the assigned parking you may not need the pass and can leave in condo unless asked to put in auto. This is just another thing to keep up with along with wristbands. Events are one of those times.) No others cars are permitted to park in the community. Cars without passes may be towed at the guest expense. For extra storage needs during your stay you are provided a storage unit #9. A cooler, air Compressor, Beach chairs, Beach Toys and Umbrella are provided for your use but not guaranteed.

Minimum Stay: Minimum stay is 2 days with a weekly rental in the summer months Saturday to Saturday. If you have a question about a longer Snowbird stay, please contact the owner direct.

INCLUSIVE FEES- Rates include a cleaning service and Security Fee Damage Ins. (Non-Refundable). There is NO DAILY MAID SERVICE. Guests will need to provide their own paper items and cleaning supplies. An initial set up is provided. Extra items needed are the responsibility of the guest. (i.e. Bring your tooth paste, laundry detergent, soap, beach towels, extra toilet paper etc.) Although a few items are provided for your use to borrow but cannot guaranty the condition of the items at the time of your arrival. (Beach Chairs, Beach towels, Wagon, Cooler etc) You are encouraged to add what you have left over for the next guest.

SYSTEM FAILURE: In case of failure of a system or amenity during your stay, including but not limited to, water, sewer, heating, air-conditioning, electrical, mechanical, ventilating, structural systems, major appliances, or entertainment equipment, we shall promptly repair them. You agree to permit access to the House to make repairs. We shall not be liable to You in damages, and NO REBATE OR REFUND will be given for such temporary failure, provided We are repairing the system or amenity in a reasonable manner after having received notice from you that repairs are needed.

AMENITIES OFFERED: Everything will be done to make sure what was offered in any advertising will be in the property as described. There may be times when the exact amenities are not in the property. Every attempt is made to keep the inventory as advertised. A difference in amenities does not entitle You to any refund of rents paid. Amenities may be added or removed at the owners/managers’ discretion.

ERRORS/OMISSIONS: Double booking is rare. We will be careful to avoid conflicts with reservations; however, if through error/omission, other tenants are occupying the rental unit or the unit is otherwise unavailable for any reason on the dates of the rental agreement, we will attempt to find a substitution accommodation of a similar quality/price range when the error is discovered. If there is no replacement property found or if you reject the replacement, a refund of all rents and fees You paid shall be Your sole remedy for any and all damages, liability or inconvenience arising out of the double booking. In no event will renter be permitted to demand removal of those occupying the rental unit.

SHORT-TERM RENTAL: It is expressly understood and agreed that this is a short-term vacation rental and is not a lease or other long term residential tenancy agreement. This Agreement is only for the use of the Property for the stated Term. It creates no property rights in You, the Guest, and no rights to renewal or for recurring usage.

UTILITIES: The landlord will provide water, heat, electric, trash removal from Dumpter and posibbly local telephone usage. Lessee is responsible for all long-distance calls made during tenancy.

RESTRICTIONS: No trailers, boats, jet skis or motorcycles allowed inside the complex. No grills allowed on the balconies. There is a "Grilling area" next to the pool. No smoking in Condo. No Candles.

ACCOMMODATIONS: The property is furnished and includes 1 King Bed /1 Queen Bed/ 1 Twin Bunk/ 1 Sofa Sleeper/ Full Size Washer and Dryer/ Stove/ Refrigerator/ Microwave/ Dishwasher/ Keyless Entry/Cable/Internet/Blender/Coffee Maker/Towels/Linens. 1 Mini Frig. Dishes, Glassware, Silverware, Pots and Pans.

MAXIMUM NUMBER OF OCCUPANTS: The house is to be occupied by no more than 7 (Seven) persons at a maximum. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. No chaperoned groups VIOLATION OF THIS PROVISION SUBJECTS LESSEE TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT-TERM SUMMER VACATION RENTAL.

FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.

LESSEE assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.

LESSEE assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and/or locked out shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).

LESSEE agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.

LESSEE and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.

LESSEE agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.

LESSEE agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the LESSEE, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.

LESSEE agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.

In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from LESSEE but shall make an attempt to contact LESSEE to make aware before entering.

LESSEE may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.

If LESSEE abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.

In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.

Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.

The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners are required to conform to all Policies and Procedures. Violators are subject to eviction.

LESSEE assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the LESSEE.


Cancellation Policy: Cancellation or changes of reservations with advance payments. Cancellations that are made more than (60) days prior to the check in date will forfeit a minimum charge of $ 50.00. Cancellations that are made within (60) days of the check in date forfeit the full advance payment. Any changes that are made more than sixty (60) days prior to the check in date will not be penalized. Any changes made within (60) days of the check in date that result in a shortened stay, change of dates, may result in loss of entire advance payment. Cancellations and early departures due to inclement weather do not warrant any refund of rent.

CREDIT CARD AUTHORIZATION: I understand and consent to the use of the credit card provided without original signature on the charge slip, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not be limited to: unauthorized long distance telephone and cable TV charges; damages beyond normal wear and tear; unreturned keys if needed, and parking infractions.

POOL: All persons using the pool area to do so at their own risk and sole responsibility. KIDS MUST BE SUPERVISED ALL THE TIME IN THE POOL AREA. Owners assume no responsibility for any accident or injury in connection with such use. Persons using the pool agree with the Owners for and in consideration of the use of the pool, to make no claim against the owners for or on account of any loss of life, personal injury, or damage to or loss of personal property.

Check Out Procedures

We know you are on Vacation and we do appreciate your business. But we do have to ask that you abide by our Check Out Procedures. The main reason for this is so we can get the unit ready for the next guest. They arrive only hours after you leave. If you leave the unit in great shape, the next family can have access to the unit on time. We really appreciate you following these procedures.

Most of our guest follow all of these rules very nicely, but for the few that do not, this is notice that a $50.00 fee per incident or per hour which ever applies will be charged to your credit card.

  1. Check-out time is by 10:00 am local time. Our managers and cleaners arrive at 10:00 am to start cleaning the unit.
  2. Make sure you leave the parking and swimming passes on the counter (and the keys in the lock box if used). Lock the doors both bottom and (deadbolts when you leave only if no rental behind you). And lock all windows. Turn Thermostats to 72 for Summer and 68 for winter months.
  3. Take ALL of the trash in the unit, including the bathrooms and bedrooms, to the bins outside the unit. This is the most common problem. And place in the Dumpster at the back right of the Complex.
  4. Put ALL dishes in dishwasher, put soap in and turn on.
  5. Wipe down all kitchen counters and sweep the floors.
  6. COMPLETELY empty the refrigerator.
  7. Bring all used towels downstairs in front of washer dryer. We provide a washer and dryer and one starter soap cube for your use. We do encourage you to do laundry during the week to keep up with the load of laundry.
  8. Strip beds and bring downstairs to washer dryer and start a load of towels if you have pod remaining. DO NOT REMOVE Dust Ruffles and Mattress Pads. Leave on beds and place Comforters and pillows back on beds please.
  9. Make sure all outdoor furniture is in original position.
  10. Please leave the home neat and orderly to avoid additional charges. If the cleaning crew finds that the home has been left excessively dirty you will be billed for the additional cleaning time at a rate of $50 per hour. Please leave the house in as good as shape as possible. The cleaner we find it, the faster we can turn it over to the next guest. We appreciate your help.

Damages: You are responsible for any and all damages that occur to the property or it's contents by you or any other member of your group while you are the registered occupant of the property. In lieu of a security deposit we will keep your credit card on file as a security deposit. If we discover that there has been damage to the property or it's contents while you are the occupant, we will capture an amount from your credit card to cover the estimated cost of repairs. The amount we capture will be an estimate and will probably be more than the actual cost of repairs. We will provide a statement of the damages and the cost of the repairs after they have been completed. If there is a refund due it will be returned to the credit card after all repairs have been made. If the cleaning company detects any evidence of smoking in the homes not specifically listed as a smoking home, you will be billed an additional $200 to deodorize the home.

DAMAGE INSURANCE: In lieu of a security deposit we will hold your credit card on file. If there are damages to this unit during your stay, we will bill your credit card and send you an invoice. You agree to this by booking this unit. The balance of rent and any other fees are due 30 days before you arrive. You can mail a check to Janet Ayers or Paypal. This information will be emailed to you. If you are booking this within 30 days of arrival, the total amount is due at time of booking. The DAMAGE INSURANCE covers accidental damage to your rental, with a limit of $3000. You will be responsible for any damage above that amount. The DAMAGE INSURANCE does not cover intentional damage, damages resulting from non-compliance with the terms of this Agreement, or damages resulting from negligence of guest. You must complete a Report of Accidental Damages form, which must be obtained from the myself within 24hours of incident, or your Insurance is void and you will be held responsible for any damages. Pet damage is the responsibility of the lease holder. You are responsible for any and all damages that occur to the property or its contents by you or any other member of your group, individually or collectively, while you are the registered occupant of the property.


All guest agrees to follow these rules that are posted at the property.

  1. All Guests MUST be 25 to Rent and present in the unit for the entire stay. Unaccompanied groups of students are not permitted (see attached Group Rules and Regulations)
  2. There must be a minimum of one parent for each four children, present in the unit for the entire stay.
  3. No boats, trailers, recreational vehicles, jet-skis, campers or commercial vehicles may park in Condo or the parking lot. Such vehicles will be towed at the vehicle owner's expense.
  4. Parking is limited to two vehicles per Condo. Vehicles must display a parking pass at all times. Non-permitted, un-authorized and non-identified vehicles will be towed at the vehicle owner's expense.
  5. Condo residents, tenants or guests shall not park their vehicles in the Condo parking lot. Such vehicles will be towed at the vehicle owner's expense.
  6. No activity that would constitute a disturbance including loud noise is permitted after 10 p.m. and before 8 a.m.
  7. Swimming Pool: [No children under the age of 12 permitted in pools at any time without adult supervision]. Use at your own risk. Pool is for Sand Dollar Guest only. Pool rules must be followed at all times, including hours of use. Please read the regulations as you enter the pool area.
  8. No clothing, towels or objects may be hung from balconies.
  9. No Grilling on Balcony this is a fire code violation. /Do Not throw anything including Cigarette Butts off balcony or scream from balcony. Fines will apply for littering anywhere on property. No open flame devices, gas grills or charcoal grills of any sort are permitted. Please use designated grilling area. No grilling on balconies. Please be respectful of your neighbors.
  10. Wheelchairs: The Condo is not Handicap accessible and there is “NO” wheelchair access.
  1. Household garbage must be placed in Garbage Dumpster located in the Garbage Enclosure in the back of the Complex. Fines will apply for improper trash disposal.
  2. Pets are NOT allowed. (Long term rentals. Pets must be on leash when on property if approved by owner prior to check-in. Walk pets in the designated area only, and dispose of droppings with a bag and scoop.)
  3. Keep the grilling area clean. Use the provided garbage containers, and do not leave anything behind.
  4. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.
  5. Fines of $100 per violation per day or occurrence, to a maximum of $1,000 per violation, of any of the Association Regulations and Rules shall be levied.
  6. Eviction of tenants who violate Regulations or Rules shall be implemented if needed. Management and/or Security personnel shall make the decision to take this action if in their judgment, it is needed.
  7. Only use appliances for their intended uses.
  8. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit bath towels or linens to be taken from the units to the beach. Please do not take the bathroom towels or any of the bedding/blankets to the beach. We have provided two beach towels for you to use during your stay that can be used at the beach. Do not take Silverware or utensils.
  9. Do not interfere with owner’s belongings in any locked owner’s closets. Doing so will be considered as theft of property and will be handled as such.
  10. Smoking is NOT allowed / Smoking is allowed outside only.
  11. Please do not unhook TV’s or move. We have taken great care to provide you with every option for your viewing. DO NOT REMOVE and DO NOT MOVE TO ANOTHER ROOM.

Evacuation procedures are in the manual in the condo with maps and phone emergency numbers.

Occupants must comply with all regulations of the Condo Association as presented from time to time, and the Covenants of the Association. Owners shall provide the regulations to all rental customers, rental management companies and guests if the occasion shall occur.

Guests and guardians assume all risk of injury or other losses resulting from the use of residence or any other recreational activity while staying at the residence and will hold the Agent and/or Owner harmless with respect hereto.
