YOUR LEASE MAY BE TERMINATED IF YOU VIOLATE ANY PORTIONS OF THIS TERMS AND CONDITIONS. YOU AND YOUR GROUP MAY BE REQUIRED TO LEAVE WITH NO REFUND OF PAYMENTS.
The lease is between the lessee/guest and KNP LLC/lessor.
This is your short-term vacation rental agreement. This agreement outlines everything you need to know about our rental policies for our property. Our goal is to ensure that your stay at our property is wonderful and meets all of your expectations. Please let us know if you have a technology or equipment issue during your stay and we will get it resolved. If you have any questions, please reach out via email, phone or booking engine.

RENTAL AGREEMENT: This Agreement constitutes a contract between the Guest (you, your) and Owner (us, we, our, KNP LLC) of the Vacation Rental Property (DEJA BLUE). By signing this agreement (electronically signed upon booking), you and your guests are agreeing to all terms and conditions listed in the rental agreement. Your vacation rental is a transient rental under state law. This means that your tenancy is temporary for the stated time period only. At no time is the property to be sublet or assigned to another individual. Please do not make any repairs, alterations, or improvements in or about the property without reviewing with us first.

CONFIRMATION AND RESERVATION: Your reservation is confirmed when we receive your electronically signed rental agreement and an advance payment. The name on this agreement must be an adult who is at least 25 years old, and will be the responsible party for the reservation and all rental obligations. We do not rent to Groups under 25 years old, Spring Breakers or Chaperoned parties. If this is falsified you will need to vacate the premises and lose all payments made at any moment throughout your trip. If you instant book and do not meet our criteria stated and you are within 48 hours, there will be a $200 booking cancellation fee. The Property Manager will check property throughout the week to ensure abidance. A driver's license, Guest list may and signed agreement may be requested upon booking, prior to receiving check in instructions or during your stay. If any requests are not completed within a reasonable amount of time owner may cancel reservation.

PAYMENT: An advance payment equal to 50% of total booking is required at the time of booking. The advance payment will be applied toward the rent via credit card. The advance payment is not a damage deposit. The balance of rent is due 60 days before your arrival date. Reservations made less than 60 days prior to arrival require full payment at the time of booking. In lieu of deposit a non-refundable Damage Protection Plan fee is assessed. If a reservation is deemed to have risk a seperate Damage Deposit may be added.

DAMAGE PROTECTION PLAN: This plan covers the Guest's staying at 4443 Clipper Cove, 32541, during their reserved stay hours, up to $1,500 in Accidental Damage that happens to the Property or any Materials, Furniture, Appliances etc. subject to exclusions and limitations. Accidental Damage means a sudden, unforseen event which happens by chance, by a Guest, to the Property.
This plan does not cover damage caused by gross negligence or intentional acts, normal wear and tear, any damage that is caused by violation of the lease Terms and Conditions, theft or damage caused under the influence of illegal drugs (which are not allowed on property).
This Plan does not cover loss, theft or damage of Guest(s) personal property.
If Accidental Damage occurs please take necessary steps to protect the property and prevent further damage, report the damage timely, before checkout
Any damage or accident that is not covered under the policy will be the responsibility of you, the lease holder and your card on file will be charged.
The purchase of the insurance still requires you to follow the check-out list outlined in the check-out details (see at bottom), and you must follow all terms and conditions. Please contact owner prior to booking if you have any questions.

"DEJA BLUE" is ready for occupancy at 4PM (CST) local time on check in day of the lease. The property must be vacated by 9AM(CST) local time on the ending day of your lease. Peak Season we have Saturday-Saturday stays. Please do not arrive on property prior to your approved Check In time. Cleaners are not authorized to provide early check in due to insurance liability.
In order not to be charged any additional fees, the following must occur:
No damage is done to the house, its contents including linens.
No items are missing upon the inventory check
All debris, garbage and discards are placed in proper containers
All soiled dishes are placed in Dishwasher
There was no exceeding the maximum occupancy of the house
There was no smoking/vaping or evidence of smoking or vaping on or in property
Unit is left in good condition

RENTERS INSURANCE: You and your belongings are expressly excluded from any home insurance policy held by the owners of 4443 Clipper Cove, 32541. You understand that it is suggested that you carry renter's insurance to cover your personal belongings. Please contact your Home Insurance Company.

ARRIVAL INSPECTION AND DAMAGES: Please complete an arrival inspection on your day of arrival and report any broken items, damage or issues to us immediately. Any damages that occur during your stay must be reported timely to us. In the event that damage occurs to the property, whether reported by you or found after departure we will file the appropriate damage insurance report. If the amount of repair and/or replacement is not covered due to it not deemed accidental, renter will be responsible for any cost. Additional costs for repair or replacement will be charged to the credit card on file. We understand accidents and damages can occur and will work with each situation as appropriate.

CANCELATION POLICY: NO REFUND Policy, including shortened stays. We do not offer refunds for cancellations (including but not limited to Hurricanes, Tornados,Tropical Storms, acts of God/Universe, acts of Governmental Agencies, war, strikes, fire, medical issues, pandemics, travel delays, school/sports schedule changes, nearby construction, loss of electricity, loss of water, beach closures and restaurant/shopping closures, COVID). Outside of 60 days there is a $300 cancellation fee, within 60 days of Check In there is no refund for a cancellation. If you booked through VRBO, the VRBO Service Fee is typically non-refundable, per VRBO, in addition to the $300 cancellation fee above, which covers transaction fees. Travel Insurance is your refund within 60 days of Check In. I HIGHLY recommend Travel Insurance. "Cancel For Any Reason" Policies must be purchased within 14 days of booking. There are policies available for purchase during the booking process. SquareMouth and Insuremytrip are also great options. Please read and ensure you are buying the coverage you want.

CONDITIONS BEYOND OUR CONTROL: We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, ice storm, severe weather, inclement weather, ferry boat cancellation, nearby construction, loss of electricity, or loss of water. There will be no refund in these circumstances. We recommend you purchase travel insurance prior to arrival.

PETS: We do consider Pets at this property. Please contact Owner to review pet criteria and get approval, if your Pet was not approved and we find this is violated you will need to vacate the premises immediately with no refund. There is an additional fee for Pets, maximum 2 Pets allowed, this is not a deposit and won’t be returned – it is for the additional cleaning needed. Pets are not allowed on furniture. Pets should be crated when Guests are away from the home (1 large wire crate is provided). Pets need to be supervised in the yard especially by the swimming pool. Pets are not allowed in the Pool, if the Pet gets into the pool please contact us, the pool will need to be treated according to OSHA standards. Owners must clean up pet’s droppings. Animals will be the responsibility of their owners and shall be kept on a leash at all times. Animals cannot be left outside alone. No feeding or water containers will be permitted outside of homes. No animal may be kept which causes any annoyances of any kind to neighboring residents or their guests. We love our Pets too and want our Guests to be able to bring them. Pets must be up to date on all vaccinations and Flea/Tick prevention.

MAXIMUM OCCUPANCY: The maximum number of guests is on your rental agreement. If you are found in breach of this contract, you will be evicted and no money will be refunded. Only people who have registered with us as guests may stay overnight on the property. Additional Guests during the day, beyond who are on the rental agreement, should be disclosed to Owner/Property Manager. If excessive Guests become an issue they may be asked to leave - if not complied may be grounds for termination of rental lease with no refund.

PROPERTY FURNISHINGS: Please return all furniture items moved to their relative original locations, if this is not the case upon cleaner's arrival there may be an additional charge. Furniture will be in good condition, with normal wear and tear expected, as it was prior to the beginning of the lease term. Please do not take any property from the home, for example towels and sheets, unless designated for a purpose (ie: beach cart, toys). We understand accidents happen and weathering of furniture and items. Please notify us if you have any issues so we can remidy the situation right away. We often keep spares stored away.

GETTING HERE: The confirmation email will state the timeframe in which we will send you details about the property, including: how to access the property, check-out procedures, community rules, and names/phone numbers of emergency contacts.

ARRIVAL AND CHECK-IN: Check-in is 4PM local time (CST) on your scheduled arrival date. Check-in before 4 PM (CST) is not guaranteed. Once we receive full payment and a signed rental agreement, we will send you detailed check-in instructions. Do not enter the property until check-in time unless permission was granted.

DEPARTURE AND CHECK-OUT: Check-out is strictly at 9:00 AM (CST) local time on your Departure Date. We will provide you with check-out procedures in advance of your arrival. If you need late check out please contact us, if possible, we will do our best to meet your needs.

CLEANING FEE: A cleaning fee is included in your total payment. This includes a clean bed sheets, kitchen and bath towels, one-time cleaning, starter set of paper towel, Dish Washer tablets, Bar soap and Toilet paper in each bathroom. There may be other items in unit available for your use. There is NO DAILY CLEANING in your fee. If you need additional cleaning throughout the week, at an additional cost, it can be arranged. If check-out procedure was not followed and there is excessive cleaning necessary, you may be charged an additional fee. We have had great guests and have yet to need to assess an additional fee.

UTILITIES: The cost of normal utilities usage is included with your stay. However, you are responsible for long-distance phone calls/faxes and pay-per view movies – your credit card will be billed for any additional charges.

OUTDOOR CAMERAS: As home technology continues to progress, WIFI cameras (Ring/Nest type) are becoming the norm for owners to protect our properties, check that cleaners have arrived to prepare for timely check-in, trash is set out, weather issues and general safety of our property, whether Renters are onsite or not. Camera's are not monitored as security cameras for Guests. Guests should secure the property for the safety of their belongings as expected anywhere. Camera's may be used to enforce and verify compliance with Rental Policies. Cameras, when installed, will face from front entrance down the driveway to street and facing backyard gate. Cameras do not intrude on any private spaces, they are NOT inside the house, NOT facing inside the house and NOT facing the Pool. Any damage caused to cameras may result in additional charge to guest which may not covered on your Accident Damage Insurance if intentional.

ODOR: Please to be aware of creating odors in the house. We want to keep the property as neutral as possible. Please cook strong smelling foods outside (ie. fish, seafood, heavily spiced, ethnic food), there are two outdoor gas burners for your use and the grill. If we need to treat a strong odor in the property there will be a $100 additional cleaning fee.

OUTDOOR KITCHEN: The Outdoor Kitchen will be clean upon arrival and there are two propane tanks (1 for Grill and 1 for Burners) please call if you run out of propane. Please practice safety when using the Outdoor Kitchen - do not leave unattended and always ensure it is turned off and gas is closed after use.

POOL: The Private Pool is an amenity we offer for your stay but it is to be used at your own risk and under your own supervision, NO Lifeguard on Duty. The pool is 12ftx24ft Kidney shaped pool and is 3ft at one end and 5 ft at the other. No diving. Children and impaired adults must be supervised. KNP LLC, and its owners are not held liable. This will serve as your waiver of holding owners responsible for accidents at the pool during your stay. Gates must be closed and latched in front and back. All children and pets must be supervised. There are alarms on all doors with access to the pool. These are for your family’s and friend’s safety with children and pets around. The Private Pool is heated for a $200weekly fee or $30/day for number of days of your stay (no less than 4 days or entire stay). The Crystal Beach Cottages Community Pool is Heated during Spring Break. Guests of DEJA BLUE may use the Community Pool located upon entrance into Clipper Cove, Crystal Beach Cottages 6 houses down from house. A passcode is needed to enter Community Pool. All Guests must abide by Community Pool Guidelines; there is No Lifeguard on Duty, Swim at your own Risk. Supervision of Children is necessary. No Pets in Private Pool or Community Pool. If there is an accident in the pool of vomit or a bowel movement - please call immediately and the Pool will be cleaned appropriately per State Guidelines by the Department of Health. Accidents happen and there is no charge - unless this becomes excessive behavior. NO GLASS around the pool area.

BEACH: The closest Public Beach Access is located at Hutchinson Street and Old Scenic 98, only 0.2 Miles from the rental homes back gate. A double wide sidewalk leads you to the Beach Access where there is Small Parking lot, Pavilion, Bathrooms, and Outdoor Showers. Pets and Fires are not legally allowed on the beaches, beach bonfires are allowed in counties East and West of Okaloosa County and you can have this arranged within a couple miles of the house. To request a Beach Wheel Chair call the Destin Fire Control District 850-837-8413. Lost & Found – per City Ordinance – items left on the beach overnight are collected and held for a week at the City’s Public Services Maintenance Yard, 3949 Commons Dr. 850-837-4242. The City is not responsible for lost or damaged items.

MAINTENANCE and REPAIRS: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. We have an excellent maintenance team who corrects problems as soon as possible. Authorized personnel may enter the premises during business hours for purposes connected with repairs, care, or maintenance of the premises. Expect lawn care personnel and pool care on property at least once a week. Please call if any maintenance items need to be addressed during your stay.

PARKING: Parking is limited to 4 medium sized cars (3 minivans/large SUV’s) this includes a golf cart/low speed vehicle. You must park in the driveway – no parking on street/sidewalk/grass/Mulch/Pine Straw/Right-of-Way/Apron between side walk and street is allowed (this includes parking in the driveway and car is stretching over the sidewalk). No boats, RV’s, trailers, mobile homes, campers or other similar vehicles may be parked in neighborhood or driveway. The Okaloosa County Sheriff’s Office will ticket automobiles who do not abide by the rules and you will be billed for any fines incurred by property owner. Also there is roam towing service in place by the City and HOA for any that violate parking rules and fees will be car owners responsibility. Excessive parking notices or warnings may void your lease with no refund - and you may be required to leave.

NO SMOKING/VAPING OR OPEN FLAMES – IN OR AROUND UNIT: No smoking/vaping is allowed on the property. At anytime there is risk a fire may start due to your negligence, and you will be held liable. No candles or open flame of any kind are allowed. Upon departure, if the cleaning company detects any evidence of smoking and/or open flames, you will be charged a $200 fee.

NOISE DISTURBANCES - No fireworks, loud music or vulgar music is allowed at anytime. HOA Quiet Hours are 10pm-8am everyday.

PORCH AND BALCONIES: There is no hanging or jumping on or off of the porch, porch railing, 2nd floor balcony or 3rd floor balcony. Depending on extent you and your Guests may be evicted.

CRIMINAL ACTIVITY: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. The Laws are defined by the State of Florida and the Federal Government of the United States. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.

COMMUNITY RULES: You agree to all rules governing the community where the property is located. These rules are subject to change at any time.

CRYSTAL BEACH COTTAGES PHASE II
RULES, RESTRICTIONS, AND ENFORCEMENT
Parking is NOT permitted at any time: on the street in right-of-way, on or across the sidewalk, on the yard/lawn between a homeowner’s fence and home, overnight at the North or South entrances of the pool, on the driveway apron in the street right-of-way. All vehicles shall be parked in driveway only. PARKING VIOLATORS ARE SUBJECT TO TOWING WITHOUT NOTICE.
All vehicles must be properly registered and licensed in accordance with the State of Florida. Operators must have a valid driver’s license. Please follow all requirements of the rental company or owner.
No boat, boat and trailer, trailer alone, recreational type vehicle, or self-propelled mobile home, shall be parked for any period of time or stored or otherwise be permitted to remain on any Lot except in an approved garage or obscured from public view by either natural or artificial means.
No automobile, truck or commercial vehicle which contains lettering or advertising thereon or which is identified with a business or commercial activity, shall be parked for any period of time, or stored or otherwise permitted to remain on any Lot except in a garage attached to the residence.
Garbage and recycle containers shall be managed as follows: Garbage pick-up days are Tuesday & Friday. Recycling (yellow top container) pick-up day is Tuesday only. No garbage container shall be located at the curb for pick-up before 12:00pm on the day prior to pick-up, and garbage container(s) shall be removed from the street before midnight on the day of pick-up. Containers must be stored in a location that is not visible from the street. Garbage must be placed in plastic bags and placed in the garbage containers. Containers must not be overflowing on ground. Yard waste pick-up is Friday. Bulk pick-up is Monday. (Place items at curb after 12:00pm on the day prior to pick-up.)
No noise and disturbances past 10:00pm or before 8:00am. No fireworks, loud music, or vulgar language will be permitted at any time.
No hanging towels, banners, clothing, or other items visible from the street.
Pets shall be on a leash and all “deposits” shall be disposed of properly. No animal may be kept which causes any annoyance to neighboring residents or their guests.
No grills of any kind shall be used or stored in the front yard. Grills shall only be used or stored on the ground.
No littering of any kind. This includes cigarette butts.
Follow all rules posted at the community pool. No animals in community pool area. Community Pool closes at 10:00pm.
VIOLATIONS OF THESE RULES MAY RESULT IN A FINE OF $150, EVICTION,
OR CITY OF DESTIN PARKING TICKETS WITH FINES

INDEMNIFICATION: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property or on property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.

GOVERNING LAW: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.

SEVERABILITY: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.

FALSIFIED RESERVATIONS: If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have a right to report the fraud to appropriate authorities.

ACKOWLEDGEMENT: You have read and agreed to the terms and conditions of this agreement including the vacation rental property rules, community rules, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only.

YOUR LEASE MAY BE TERMINATED IF YOU VIOLATE ANY PORTIONS OF THIS TERMS AND CONDITIONS. YOU AND YOUR GROUP MAY BE REQUIRED TO LEAVE WITH NO REFUND OF PAYMENTS.

CHECK OUT Instructions for Deja Blue Vacation House
These will also be emailed to you before check out and posted on Property.
You Must Be Checked Out NO LATER Than 9AM (CST) on day of Departure.
If you are departing before 9AM, please text or call XXXXXXXXXXXXX to let me know what time you will be leaving. Be sure to include the expected time of departure and house. (For Example: "Deja Blue" leaving at 7am)

1)Load all dirty dishes into the dishwasher and start cleaning cycle. Please ONLY use dishwasher detergent.
2)Please empty fridge and take excess trash out. ALL house trash must be taken out.
3)Please leave all beds un-made. Please do not take the dirty linens off the beds.
4)Check Clothes Washer and Dryer for your personal belongings, if you used house beach towels please ensure they are washed and dry.
5)Sweep the floors of excess sand and debris.
6)Make sure outdoor furniture is in original position - Outdoor Cooler is emptied and personal belongings are collected.
7) Don't forget items left in garage, decks, patios...chargers etc. we may only hold items for 24 hours post check out

If you come across any maintenance issues during your stay or anything breaks or is damaged please call us or Angela Moody, Property Manager. We understand things happen and we do plan for that, accidents are also what the Damage Insurance protects you and us, owners for.

The Parties agree to the terms of this Short Term Rental Terms and Conditions.
