We would like to thank you for selecting Gulf Shores Escape Penthouse 500 at Seawind Condominiums for your vacation. Following these terms and conditions will assist us in ensuring you and your guests have a refreshing stay.

This agreement constitutes a contract between RENTER and Kyle & Megan Shirley of the vacation rental property Gulf Shores Escape at Seawind Condominium 500-SW3. By signing this agreement, you and your guests are agreeing to all the terms and conditions listed in the rental agreement. Your vacation rental is a transient rental under state law. This means that your tenancy is temporary for the stated time period only. At no time is the property to be sublet or assigned to another individual. Please do not make any repairs, alterations, or improvements in or about the property.

Unfortunately, we cannot accommodate college or high school groups. The guest that is over 25 years of age and signs this rental agreement must be present the entire stay.

Security Fee Accidental Rental Damage Protection Plan (No Deposit Required): Security fee accidental damage protection is included in the pricing for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder. Security Fee Accidental Rental Damage Protection Plan fee is non-refundable.

No Daily Housekeeping: There is no daily housekeeping service. While linens and bath towels are included with the property, daily maid service is not included in the rental rate.

NO SMOKING: Smoking in the condo will automatically incur an additional $500.00 cleaning fee.

NO PETS: Pets are not allowed in or on the property. The presence or evidence of a pet on the property will cause forfeiture of the entire rent and immediate tenant eviction. An additional cleaning fee will be charged.

CANCELLATIONS/REFUNDS: Please notify us immediately if you are unable to keep your reservation. All cancellations are subject to a $175.00 cancellation fee. Weekly or less rentals with written notice of less than sixty (60) days will cause a loss of paid rent unless the condo is re-rented for the same time period. Monthly rentals with written notice of less than ninety (90) days will cause a loss of paid rent unless the condo is re-rented for the same time period. No refunds are given for early departures. Units may not be sublet.

HURRICANE POLICY: If a mandatory evacuation is issued by the National Hurricane Center or our local governing officials due to a tropical storm or hurricane threatening our area, refunds will only be given by Travel Guard Travel Protection if you have purchased coverage before the storm was named. Gulf Shores Escape will not issue refund of any rent payments.

WE HIGHLY SUGGEST TRAVEL INSURANCE: Travel Insurance provided by TRAVEL GUARD:
Every year, snowstorms, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp). Please refer to product number 008573/008574 P1 & account # 97908.

CONDITIONS BEYOND OUR CONTROL: We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, ice storm, severe weather, inclement weather, ferry boat cancellation, loss of electricity, or loss of water. There will be no refund in these circumstances. We recommend you purchase travel insurance prior to arrival.

CRIMINAL ACTIVITY: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.

INDEMIFICATION: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.

GOVERNING LAW: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.

SEVERABILTY: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.

FALSIFIED RESERVATION: If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have a right to report the fraud to appropriate authorities.

ARRIVAL INSPECTION +DAMAGE: Please complete an arrival inspection on your day of arrival and report any broken items, damage or issues to us immediately. Any damages that occur during your stay must be reported immediately to us. In the event that damage occurs to the property, whether reported by you or found after departure, the cost of repair and/or replacement will be held from the deposit or credit card on file. If the amount of repair and/or replacement exceeds the deposit amount, you will be responsible for any additional costs. Additional costs for repair or replacement will be charged to the credit card on file.

FURNISHINGS & EQUIPMENT: You are renting our privately owned condo. It has been decorated and equipped to satisfy our particular tastes and desires. Please be considerate of our belongings and to the people who will be renting the Penthouse after you. Please do not rearrange the furniture, take any items outside that are part of the interior décor or move any furnishings or kitchen items to another property.

You will be charged if the housekeepers have to rearrange the furniture after your stay.

Renter is to indemnify Gulf Shores Escape for any damages or costs to the premises, furnishings, equipment, and household items therein, which occur during renter’s occupancy excluding normal wear and tear.

Locked closets are maintained for our personal use. Please respect these areas. If owners closets are found broken into, there will be a charge for repair of lock and replacement of any missing items.

REPAIRS: We are available to make sure your vacation home is in the best condition that it can be. If you should discover otherwise, please report it to us immediately and we will correct it as quickly as possible; however no refunds will be given for appliance failure or other circumstances beyond our control.

LOCKOUTS: If you lock yourself out of your property call (270) 590-9388.

GRILLING: Management prohibits charcoal or open fire grilling on or under decks, balconies or porches, or within ten (10) feet of any structure. Please check property for designated grilling area. (A charcoal grilling area is available)

ITEMS LEFT IN PROPERTY: Gulf Shores Escape is not responsible for personal items left in the property.

OCCUPANCY: The total number of persons allowed in the property at any time is restricted to the stated limit for each property. Eviction without refund is the penalty. We are very serious about maintaining a family atmosphere for the quiet enjoyment of all our guests. We will rent to family groups and responsible adults only. Gulf Shores Escape will not be rented to anyone under 25 years of age. No children will be allowed to check-in without their parents. Reservations made under false pretense will be subject to forfeit of entire advance payment. Identification may be required upon check-in to verify age.

INDEMNITY: Gulf Shores Escape will not be liable for any damages to rental property of furnishings nor for injuries resulting from any accident that may occur in or on the premises during the guests’ occupancy. Gulf Shores Escape will not be held responsible for acts of theft or vandalism or other damages to the guests’ personal items left in the unit or vehicle.

Rental rates does not include daily maid service or a change of linens

4 televisions, 3 DVD players, Wii, Netflix, MP3 player, and games

THESE ITEMS SHOULD NOT LEAVE THIS UNIT FOR ANY REASON – PLEASE DO NOT BRING ANY ITEMS FROM THE CONDO TO THE BEACH OR ANOTHER CONDO.

Personal items including shampoo, sun screen, laundry detergent

Tall kitchen trash bags (we provide starter bags, dumpster is located by the parking garage)

TELEPHONE

A telephone is available for local calls during your stay. Long distance calls must be billed to another number or calling card.

PARKING

Includes one parking pass. You may purchase up to three at $25.00 each plus 13% tax

Depending on the time of year Seawind Condominiums may prohibit boats, trailers, jet-skis, motor homes and buses. If traveling with any of these, please call in advance, 270-590-9388.

MAINTENANCE

We make every effort to keep our penthouse in top condition. Notify us immediately of any maintenance problem and we will strive to repair it as soon as possible. No refund or adjustment will be made for mechanical failures.

Entry Codes – Elevator = Emailed, Fitness Center = Emailed, Condo entry code: = Emailed

(Entry cod will expire at 10 AM on the date of departure).

Parking Passes/Wristband – You may park directly in front of the small Amenities Luxury Suites or in the Tower Condo parking garage. Parking passes and wrist bands should be visible at all times. When your stay is complete, please slide the parking passes and wrist bands under the owners closet (next to the refrigerator) or mail them to Megan Shirley, 356 Stone Meadows Circle, Bowling Green, KY 42103.

Pool Hours and Rules – Hours are from 8:00am-11:00pm. Children under 14 must be accompanied by an adult. DO NOT take glassware to the pool area. Swim at own risk. Kyle & Megan Shirley, Seawind Condo., Association, or Gulf Shores Escape is not responsible for injury or accidents.

Fitness Center – ACCESS CODE TO FITNESS CENTER (Emailed) Hours: 7:00am-10:00pm. Children under 16 must be accompanied by an adult. Proper workout attire is required including tennis shoes.

Balcony – Do not grill, feed seagulls, hang towels or bathing suits from the balcony. Do not lean or throw anything over the balcony (It is a felony in Gulf Shores/Orange Beach to throw anything from a balcony).

Garbage & Garbage Disposal – Garbage dumpsters are located on the bottom floor of the Tower Condo parking garage. Please avoid placing shrimp shells or hard objects in the garbage disposal. Seafood shells make for a terrible odor for you as well as the next guest.

Check-Out Procedures – Slide parking passes and wrist bands under the owners’ closet door next to the refrigerator. Take all trash to the dumpsters located in the Tower Condo parking garage. Remove all items from the refrigerator and cabinets. Clean and put away dishes. If any furniture was moved return it to its original position. Double check all drawers and cabinets to ensure no personal goods are left behind. Strip beds and put sheets and pillows cases in the hallway.

ACKNOWLEDGEMENT: You have read and agreed to the terms and conditions of this agreement including the vacation rental property rules, community rules, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only in the event damage is greater than the damage protection policy.

NEXT YEAR PRICE GURANTEE:

This year’s tenant has the first rights to the same week next year with no rate increase*. You must reserve next year within three (3) business days of your departure.

*Does not apply to last minute half price bookings or different dates…including holidays.
