Vacation Rental Agreement for Crystal Shores West Unit 705-Southern Exposure Condo

The premises is located at 931 W. Beach Blvd, Unit 705, Gulf Shores, AL 36542-6369.

Rental Agreement: This Agreement constitutes a contract between the Guest (you and your guests) and Owner (Crystal Shores Investments, LLC) of the vacation rental property Crystal Shores West Condominium Unit 705. By signing this agreement, you and your guests are agreeing to all terms and conditions listed in the rental agreement. Your vacation rental is a transient rental under state law. This means that your tenancy is temporary for the stated time period only. At no time is the property to be sublet or assigned to another individual. Please do not make any repairs, alterations, or improvements in or about the property.

Confirmation of Reservation: Your reservation is confirmed when we receive your electronically signed rental agreement and an advance payment equal to 50% of the rental rate. The name on this agreement must be an adult who is at least 25 years old, and will be the responsible party for the reservation and all rental obligations. We do not rent to young adults on Spring Break. The legal renter named on the rental agreement must occupy the property during the dates listed on the agreement. Identification must be furnished upon request. Absolutely NO HOUSE PARTIES ALLOWED.

*Please Note: Violations of rental occupancy restrictions are grounds for IMMEDIATE EVICTION AND FORFEITURE OR RENT.

Payment: An advance payment equal to 50% of the rental rate is required at the time of booking. The advance payment will be applied toward the rent. Please make payments via a credit card. The advance payment is not a damage deposit. In place of a deposit, we require a one time non-refundable $49 Accidental Rental Damage Insurance policy fee. The balance of rent is due 60 days before your arrival date. Reservations made less than 60 days prior to arrival require full payment at the time of booking.

Cancellation: If you must cancel or change dates, please call me at 985-960-2613 or email me at Info@SouthernExposureCondo.com as soon as possible. A 60-day notice for short term rentals is required. Monthly rentals require a minimum 120 day notice. Any cancellations made more than 60 days prior to your arrival will result in 100% refund. All cancellations made within 59 days or less of your arrival will result in a loss of the full amount charged (100%). We do strongly encourage you to do an internet search and purchase cancel for any reason trip insurance. Not all insurance covers hurricanes and travel bans. Make sure yours does. Minimum Age to Rent is 25. No Pets, No Smoking.

Severe Weather/Hurricanes/Tropical Storms: There are no refunds for severe weather including hurricanes, hurricane evacuations, and tropical storms. Again, it is highly recommended, but not required, that you purchase travel insurance. Not all insurance covers hurricanes. Make sure yours does. There are many plans out there including those at InsureMyTrip.com, and SquareMouth.com.

Conditions Beyond Our Control: We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, travel bans, pandemics, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, severe weather, inclement weather, loss of electricity, or loss of water. There will be no refund in these circumstances. We recommend you purchase travel insurance prior to arrival.

Travel Insurance Provided by TRAVEL GUARD: Every year, hurricanes and other unexpected weather events cause travelers to delay, interrupt or even cancel their trips completely. A travel insurance plan can help cover your vacation investment. Specific coverage questions should be directed to Travel Guard (1.877.246.5376 or www.travelguard.com/astp). Please refer to product number 008573/008574 P1 & account # 97908.

Not all insurance covers hurricanes and travel bans. Make sure yours does. We recommend you do an internet search and purchase a cancel for any reason plan.

Accidental Rental Damage Insurance Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

Arrival Inspections + Damages: Please complete an arrival inspection on your day of arrival and report any broken items, damage or issues to us immediately. Any damages that occur during your stay must be reported immediately to us so a claim may be filed. You will not be contacted by the insurance company. If damage is not covered by the insurance, costs will be charged to the credit card on file.

The purchase of the insurance still requires you to follow the check-out list outlined in the check-out details and you must follow all terms and conditions.

Insurance: You are expressly excluded from any insurance policy held by us. You understand that it is suggested that you carry renter's insurance to cover your personal belongings.

Minimum Stay: A minimum stay is required at our discretion.

Accommodations : One King, One Queen, One Twin and One Queen Sleeper Sofa

Maximum Occupancy: The maximum number of guests is 7 (babies in cribs not included). If you are found in breach of this contract, you will be evicted and no money will be refunded. Only people who have registered with us as a guest may stay overnight on the property.

We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. No chaperoned groups. VIOLATION OF THIS PROVISION SUBJECTS GUEST TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM SUMMER VACATION RENTAL.

Falsified Reservations: If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have a right to report the fraud to appropriate authorities.

GUEST assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.

GUEST assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).

GUEST agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.

GUEST and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.

GUEST agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.

GUEST agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the GUEST, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.

GUEST agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.

Upon not less than 24 hours notice, GUEST shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants.

In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from GUEST.

GUEST may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.

If GUEST abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.

In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.

Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.

The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners are required to conform to all Policies and Procedures.

GUEST assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the GUEST.

Property Furnishings: You agree to return all furniture items in a similar good condition, with normal wear and tear expected, as it was prior to the beginning of the lease term. Some internet photos may differ due to owner updates or changes.

Arrival and Check-in: Check-in is 3 PM local time on your scheduled arrival date. Check-in before 3 PM is not guaranteed. Once we receive full payment and a signed rental agreement, we will send you detailed check-in instructions.

Departure and Check-out: Check-out is 10 AM local time on your scheduled departure date. Check-out is strictly at 10:00 AM. We will provide you with check-out procedures in advance of your arrival.

Utilities: The cost of normal utilities usage is included with your stay. However, you are responsible for long-distance phone calls/faxes and pay-per view movies.

Maintenance / Repairs: Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. We have an excellent maintenance team who corrects problems as soon as possible. Authorized personnel may enter the premises during business hours for purposes connected with repairs, care, or maintenance of the premises. Expect lawn care personnel on property once a week.

Community Rules: You agree to abide by all rules governing the community where the property is located. The rules are posted inside the property and/or at the community office. These rules are subject to change at any time. Each guest needs to wear a wristband provided in the unit upon check in while using guest facilities. There will be a parking pass available at check in.

Parking: Parking is limited to 2 cars. You must not park in a reserved space. There are unreserved parking spaces throughout complex. Parking passes are required and can be obtained through Sun Coast Rental located in the office at Crystal Shores West.

No Pets: Our community does not allow pets. This is not a decision made by us, this is a rule set by the Homeowners/Condominium Associations. If a pet is found on the property during your stay, we have a right to ask you to vacate the property immediately with no refund of any kind. Upon departure, if the cleaning company detects any evidence of a pet, additional fees may apply. The credit card on file will be charged.

No Smoking or Open Flame: No smoking is allowed inside the property. No candles or open flame of any kind are allowed inside the property. Upon departure, if the cleaning company detects any evidence of smoking and/or open flames. Additional fees may apply and the card on file will be changed.

Cleaning Fee: A cleaning fee of $145 is required. Rate includes a one-time linen setup and cleaning service at the time of departure.

No Daily Housekeeping: There is no daily housekeeping service. While linens and bath towels are included with the property, daily maid service is not included in the rental rate. If excess cleaning is required after your stay, an additional charge may be placed on the credit card on file. Guests will need to provide their own paper items and cleaning supplies. We provide the following for the guests:

Wifi , Cable TV, first roll of toilet tissue in each bathroom, soap for each bathroom, 2 dish towels for kitchen, dishwasher tabs, Kitchen plastic bags. Bathrooms have 4 to 6 sets of towels and wash cloths, 2 hand towels and 1 bath mat.

You will need to bring your toothpaste, laundry detergent, beach towels, extra toilet paper, etc)

CHECK OUT:

  1. Dispose of all trash in proper outside containers.
  2. Please load all dirty dishes in dishwasher and start it.
  3. Close and lock all doors and windows when leaving. I know the sliding doors are heavy but please makes sure the closed and locked.
  4. Turn off all lights, fans, tv's, stove.
  5. Turn the AC to 78 degrees in the Summer and 66 degrees in Winter.
  6. Leave all wrist bands on counter if possible. Thank you.

Criminal Activity: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.

Indemnification: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.

Governing Law: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.

Severability: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.

Acknowledgement: You have read and agreed to the terms and conditions of this agreement including the vacation rental property rules, community rules, and weather/pet/smoking/cancellation policies. The credit card supplied at the time of reservation will be held for security purposes only.

CREDIT CARD AUTHORIZATION:

I understand and consent to the use of the credit card provided without original signature on the charge slip, I understand that by "clicking" that I have read the terms and conditions of this property, I am bound by this agreement and I have signed "electronically, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not limited to: unauthorized long distance telephone and satellite TV charges; damages beyond normal wear and tear; unreturned keys, and parking violations.
