"MOONSTRUCK LODGE" Terms Conditions/Policies
PROPERTY IS NO REFUND FOR CANCELLATION OR LATE ARRIVAL OR EARLY DEPARTURE.

Check -in and Check-Out Times
Check- in time is no earlier than 4:00 PM EST, and premises must be vacated no later than 10:00 AM EST on the ending date of the rental, as housekeeping will enter promptly at 10:00 AM. For each 15 minutes you are late leaving, you could be charged $50.
Damage Deposit: We may require a separate refundable deposit for damages. By accepting the terms of this lease, you agree that you can be charged for damages. You will be emailed immediately before any charges.
Any damage noticed on arrival should be reported to owners immediately. Additionally, all accidents or damages while at the premises must be reported within 12 hours of occurrence. Guest understands they are solely responsible for, and assume all liability for, any damage(s) to the premises, amenities, equipment, or furnishings. This include damages caused by other guests, invitees, licensees during their stay.. Any general maintenance issue should be promptly reported so the unit can be kept in good repair. We do not offer refund for cleaning issues..but happy to send a cleaner to cabin to remedy any serious issues you have if you report this to owner at arrival.
To have the full amount of your damage deposit returned, all must be met:
a) No damage is done to the unit or its contents including the linens.
b) No items are missing upon the inventory check.
c) All debris, garbage and discards are placed in proper containers and all soiled dishes placed in the dishwasher.
d) The maximum occupancy of the unit was not exceeded and there was no smoking or evidence of smoking, or pets or evidence of pets.
e) Unit is left in neat condition and all doors and windows are locked.
f) The Guest(s) is not evicted by the owner (or representative of the owner), the local law enforcement, or any security personnel.
g) No unauthorized use of wifi, as detailed in internet section, when documented, during your stay.
Deposit: A deposit or damage policy may be due at the time the cabin is booked. if 2 payment booking, and booked more than 60 days before your stay. You will be asked to pay at the end of the online booking process. Remaining balance is due 60 days before your arrival date. Balances not paid when due are subject to forfeiture of prior payments.
Access/Welcome Letter: Will be provided during the month prior to your stay. Entry codes will be sent on the date of your arrival. 4pm Check in time is Firm, and entry code may not be provided prior to 4pm.
Cabin Set Up: When you arrive, cabin should be clean and set up with linens and supplies as itemized below. We will do our best to correct any cleaning or maintenance issues, but must be made aware of the problem at your arrival.
Check Out Procedure: Please leave cabin neat and orderly to avoid additional charges. If housekeeping finds the home has been left excessively dirty, you can be billed for additional cleaning at a rate of $50 per hour. Beds should be left unmade with sheets, comforters and pillowcases left on the beds. Used towels/washcloths from bathrooms, and soiled dish towels, wash cloths, even pot holders, if soiled, should be placed in the nearest bathtub All trash, and anything left in the refrigerator should be placed in the outside trash cans. Before leaving, please set the thermostats to 55 degrees in cooler months and 80 degrees in warmer months. Close and lock all windows. Make sure the wifi deadbolt is set to locked before you leave, and tv remote controls are either on bedside stands, or on the chest in the theater room. Remote controls are marked on back as to their designated location. If there is any accidental damage, or something is not working, please email owners with picture and details.
Supplied Items: Linens for 2 king beds, linens for 2 queen beds, linens for the 2 twin beds, blankets, pillows are provided. One bath towel, 1 wash cloth per occupant are provided. Also, 3-6 hand towels, 2 dish towels, 2 dish cloths, potholder and oven mitt, laundry detergent, dish detergent, automatic dishwasher detergent, bath soap, 1-2 roll paper towels, 1-2 rolls toilet paper per bathroom, and 1-2 trash can liners are provided. You will likely need to replenish these start up supplies during your stay.
Hot Tub: If there is a problem with the hot tub, contact owner. Bromine is used to maintain water quality. Please note safety warnings posted by the hot tub before using it. Use of hot tub is at your own risk. Pregnant women and those with pre-existing health conditions, or infected wounds are advised against using the hot tub. Children under 12 are prohibited from using the hot tub without supervision. Guests should shower both before and after hot tub use. No oil or soap should ever be added, and if inspection reveals residue from oil, soap, food, alcohol, etc, guest can be charged a cleaning fee up to $100. Do not eat or drink in hot tub!! Do not STAND OR SIT on the hot tub cover, as replacements are $400. If water is splashed out, lowered water level could damage motor. Please secure cover on hot tub when not in use. Cover is just styrofoam and can be easily damaged. DO NOT SIT ON LEATHER FURNITURE IN WET CLOTHING FROM HOT TUB..BROMINE DAMAGES FURNITURE!!!!!!
Gas Fireplaces: The cabin has a gas fireplace in 2 rooms. To turn on FP, use timer at side of FP. The fireplace is operable October 1 through February. Please do not put any items in the fireplace, rearrange or tamper with logs or associated timers. DO NOT REMOVE GLASS!! If there is any evidence of tampering during or after your stay, you will be charged a minimum of $150 Fireplace Technician Service Charge. Report any questions/issues to owners.
Severe Weather: We do not refund rents or deposits due to canceled or shortened stays for any reason, including or because of weather, including snow/ice. Departures, canceled stays, or late arrivals due to inclement weather do not warrant any refund of rent or deposit. Electrical outage, water outage must exceed 12 hours for refund of any type to be considered.We highly recommend getting travel insurance for your trip.
Smoking Policy: Absolutely no smoking is permitted inside the cabin- NO EXCEPTIONS. You can be evicted with no refund, and an additional charge of $300 to deodorize cabin. If you smoke on the deck, please do not throw butts on the ground. Make sure the butt is out and place butts in the outside ash can on each deck. If housekeeping has to pick up butts, there may be extra charges. This policy is STRONGLY ENFORCED, and can result in immediate expulsion with no refund!!
Pet Policy: Absolutely no pets are permitted- NO EXCEPTIONS. If any evidence of pet(s) is found inside the cabin or on the premises, you will be asked to vacate immediately with no refund of rent and you will be charged $200 for violating the lease agreement. Our HOA does patrol the resort and does report pets in pet free cabins. We also have outdoor monitored cameras. This policy is STRONGLY ENFORCED.
Accommodations: The cabin includes two king size beds, 2 queen sized beds, 2 twin sized beds. There are three full bathrooms with tub and standing showers, one jacuzzi tub, one hot tub, and a dual gas fireplace in 2 rooms. Under no circumstances are furniture, bedding, mattress pads, utensils or any other item supplied with the rental property to be taken out, moved, or rearranged. Locked locations are used by the property owner, and are not included with this rental, nor are they to be tampered with. Driveway accommodates 2-3 vehicles, if there are more than 3 vehicles, or trailers, RV’s etc. there is extra parking at Resort entrance. DO NOT PARK ON ROAD..HOA TOWS! We have well water. It is normal for well water to have lower water pressure than city utility provided water. It is wise to stagger showers or baths.If water treatment backwashes you may have no water once daily for 4-5 minutes. It is normal to have occasional water or electrical outage. No refunds will be considered if less than 12 hour outage.
Cable TV: We cannot guarantee any programs, events, or subscription levels. Guest(s) should not attempt to use Pay Per view services, remove/add any locked channels, nor remove/reattach any existing audio/visual cables including but not limited to TV’s, DVD players, movie projector or CD players. Guest(s) will be responsible for all service call charges at $200 Fine per occurrence.
Internet Access: Comcast Wifi. Virtually Unlimited. Fast..enjoy!
High Definition Audio and Visual Equipment: Moonstruck Lodge is equipped with a High Definition movie projector in the theater. Guest(s) are strictly prohibited from tampering with, or interfering with, the sensitive components, cables, and interface of the system. No cables, plugs, DVD players, TV receivers or stereo receivers are to be manipulated from the original setup. No Xbox, Nintendo, Playstation, Wii, or any other similar gaming device is to be connected to the theater components. Doing so will result in an immediate NO EXCEPTION fine of $500, a high definition bulb replacement at $475 minimum, and an additional technician trip charge applied to the Primary Rental Guest(s) credit card. Service calls start at $129.00 and are charged by the hour. The nearest service center is in Sevierville, TN which operates Monday thru Friday 8 am to 5 pm, and charge a minimum of two hours round trip plus labor and parts. Charges for a High Definition Theater projector service call will be charged to the credit card on file. NO EXCEPTIONS. Please turn off projector bulb at the wall switch when not in use.
Maintenance: While owner cannot offer refunds or discounts for amenity malfunctions (appliances, electrical, hot tubs, TVs, fireplaces, etc.), we do perform regular maintenance to insure good working order. If there is a problem, we will make every effort to correct it as soon as possible during regular business hours. Emergency issues (i.e., lack of power or water in cabin, severe leaks, fire, security issues, accidents, locked-out of cabin, etc.) should be reported immediately. All non-emergency issues (i.e., appliance/amenity issues, etc.) should be addressed during regular business hours or guest could be charged additional fees. Should a repair technician make a call to a rental property unit and find the equipment is in working order and the problem was due to the Guest(s) oversight or neglect, the charge for service will be at the Guest(s) expense. Please note: AREA MINIMUM SERVICE CALL FEES START AT MINIMUM $75.00. Guest(s) understands and agrees that owners and/ or contractor may enter the rental property with prior notice at any reasonable time for the purpose of making any needed repairs.
Cleaning: Rates include initial linen setup and cleaning service at the time of departure. There is no daily maid service. Additional paper items beyond the initial supply will be the responsibility of the guest.
Maximum Number of Occupants: The cabin is to be occupied by a maximum of 10 persons at any time, NO EXCEPTIONS EVER. House parties/events are not allowed, and we do not rent to vacationing students or anyone under 25 years of age unless accompanied by an adult guardian or parent. Any reservation obtained under false pretenses will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check in, and/or subject to immediate eviction with no refund of funds paid.
Left or Lost Items: If you realize you left something, contact owner. We will do our best to locate, but cannot be responsible for left/lost items. If found, UPS will ship and contact you for your credit card it you want item.
Cancellation Policy: NO REFUND WHATSOEVER FOR CANCELLATION OR NO SHOW. For this reason, we strongly recommend you purchase trip insurance to protect your vacation investment.
Refunds/Maintenance: We do everything possible to keep all equipment in good working order. However, it is impossible to guarantee that all appliances, hot tubs, TVs, fireplaces, internet service, etc. will be in working order 100% of the time. We will make every effort to correct problems as soon as possible during normal business hours. If a service call is necessary, we will do our best to avoid inconvenience to you. We do not offer discounts, refunds, or credits for mechanical malfunctions.
Owners Closet is not a part of rental. Any vandalism or entry into closet(s) will result in criminal charges filed.
Indemnification and hold harmless: Guest(s) agree to indemnify and hold harmless the Owner for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property. This is including, but not limited to, any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). The term “Owner(s)” as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms “Guest(s),” “Licensee of Guest(s)” as used in this Agreement shall include Guest(s) heirs, successors, assigns, guests, invitees,licensees, representatives and other persons on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this Agreement to be at the rental property), where the context requires or permits.
Disputes: This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas, and shall be treated as though it were executed in the County of Nueces, State of Texas. If action relating to this Agreement is instituted in Nueces County, Texas, guest(s) specifically consents to such venue and jurisdiction and to extraterritorial service of process.
I have read and understand the above rules and regulations. By booking this property, I am agreeing to all terms and conditions in this document, including any and all cancellation and damage terms. I am at least 25 years old, of sound mind, and I am responsible for any and all damages that occur to the property or it's contents by me or any other member of my group, or any guest's licensee while I am the registered occupant of the property. I accept full responsibility for damages, fees, or extra cleaning or internet charges should they be found during or after my departure. I understand and consent to the use of the credit card provided without original signature on the charge slip, and that this credit card authorization cannot be revoked and will not terminate until 30 days after the leased premises are vacated.
