TERMS/CONDITIONS:

The property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease, if we can provide earlier access we will.

Unit must be vacated by 11:00 AM local time on the ending date of the lease. Late Check-Out: must be scheduled prior to arrival for an additional fee.

The property is located at: HONUA KAI RESORT-HOKULANI #205, 130 Kai Malina Pkwy, Lahaina, HI 96761.

Accommodations: 2 master suites, 2 full baths, full kitchen/laundry, living/dining room, lanai.

PAYMENT DUE DATE:

$1000 due at time of booking.

Remaining Balance: 90 days prior to arrival.

Rents not received by the due date will be considered a cancellation of this lease by you with forfeiture of all rights and deposits paid.

CANCELLATIONS:

Cancel 60 days or more prior to arrival date-$500 non-refundable

Cancel less than 60 days prior to arrival date- No refund (any monies received from possible re-booking will be returned)

Any change to dates specified in the lease may result in a higher rate. We will try and accommodate requests if possible.

Travel Insurance is available on this site and we recommend you consider its purchase if you are concerned about a loss of your vacation investment.

ACCIDENTAL RENTAL DAMAGE:

You are responsible for any and all damages that occur to the property or its contents by you or any member of your group, individually or collectively, while you are the registered occupant of the property. Accidents do happen, if damage does occur please let us know so we can arrange for repairs. Any damage noticed upon arrival or general maintenance needs should be reported to the concierge/owner immediately. Damage insurance is available on this site to cover any unforseen accidents.

PROPERTYFEE/INCLUSIVE AMENITIES:

Property Fee includes self-parking, high speed internet, use of all resort pools, pool towels, fitness center, phone calls to local/US mainland/Canada. Any additional phone charges will be guests responsibility. Fees/Services/Amenities goverened by the resort/owner and are subject to change at any time without notice. When amenities/services are unavailable it is usually due to maintenance/improvements and we appreciate your understanding. A difference in amenities/services offered does not entitle you to any refund in rents paid.

HOUSEKEEPING:

An initial set up of linens/toiletries are provided but will not be replenished during your stay. Extra items needed are the Responsibility of the Guest. There is No Daily Maid Service. Additional Housekeeping Services are available for a Fee and Must be Scheduled in Advance.

VOIP PHONE/911

We are providing Voip phone service during your stay. When calling 911 be prepared to give the operator your location:

Honua Kai Resort, 130 Kai Malina Pkwy #205, Hokulani Tower, Lahaina

In case of a power outage or other service issue that effects phone service you will need to use your cell phone to call 911. You must notify other members of your household and other potential usuers the nature and limitations of 911 emergency calls. We assume no liability if you have difficulty in calling during a 911 emergency. Resort Secuity can be reached at 808-866-5560.

ADDITIONAL CHARGES:

In order to avoid additional charges the following must occur:

a) No damage is done to the unit or its contents including the linens, most accidental damage is covered by insurance.

b) No items are missing upon the inventory check.

c) Unit is left in neat condition: no excess sand, ect,. Additional housekeeping outside of normal will be charged at $95/hr.

d) There was no exceeding the stated occupancy of the unit according to the lease

e) There was no smoking or evidence of smoking in the unit or on the lanai. Resort Security monitors. Cleaning fee applies. $500 minimum. (see below).

f) Additional phone charges not covered above, lost pool towel charge $20.

MAXIMUM NUMBER OF OCCUPANTS:

The condo is intended to sleep no more than 4 people. Any additional guests need to be Registered in advance with the Permission of the Owner. Any permitted changes to occupancy will result in a Change of Rent. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. No chaperoned groups. No Events or Parties. If a violation of this provision occurs or a reservation is obtained under false pretense, you will be subject to forfeiture of any deposit and rents paid and you will not be permitted to check-in or will be asked to vacate immediately.

NO SMOKING/RESORT RULES:

ABSOLUTELY NO SMOKING or PETS are allowed in the Unit or on the Lanai at any time. If any evidence of smoking or a pet is found you will be asked to vacate immediately with no refund of rent. An additional cleaning fee of $500 minimum will be applied and you will be resonsible for any damage and/or the removal of any residual smell. HI takes its smoking restrictions seriously. Resort security will report any infractions. No bicycles or surfboards allowed in the Unit or on the Lanai at any time, Contact Security for storage. Guest agrees to abide by the rules of the Resort. Any failure to follow resort rules may result in the assessment of fines or penalties which will be the Guests Responsibility. Guest and the members of your party shall not be a nuisance to neighbors nor use the premises for any unlawful purpose.

POOL/OCEAN/BEACH USAGE:

All persons using the pool/ocean/beach area do so at their own risk and sole responsibility. There is No Lifeguard on Duty. CHILDREN MUST BE SUPERVISED AT ALL TIMES. OWNER ASSUMES NO RESPONSIBILITY for any accident or injury in connection with such use. Persons using the pool/ocean/beach agree with the owner that in consideration for their use, no claim against the owner will be made for any loss of life, personal injury or damage to or loss of personal property.

INDEMNIFICATION/HOLD HARMLESS:

Guest acknowledges and understands that every member of his/her party is soley responsible for any accident, careless act, negligence, injury, or loss sustained to any person while in-residence, and the Owner accepts no legal or financial responsiblility. Guests asume all risk of injury or other losses resulting from the use of residence and or any other recreational activity/amenity while staying at the residence/resort and will hold the Owner harmless in that regard.

SYSTEM FAILURE/UNIT ACCESS:

In case of a failure/breakdown during your stay, including but not limited to utilities, mechanical systems, major appliances, telephone/entertainment equipment, ect., we shall make every attempt to promptly make repairs, however, service does not always happen quickly on Maui and we appreciate your understanding in advance if we are unable to resolve an issue while you are in residence. You agree to permit access to make such repairs and understand we shall not be held liable to you in damages and no refund will be given for any such failures. We will provide notice if it is necessary to access the unit for routine/scheduled maintenance. In the event of an emergency you will allow access to the unit by owner/agent at any time without securing prior permission from you.

ACTS OF GOD/ERRORS/OMISSIONS

We shall not be liable for events beyond our control which interfere with your scheduled occupancy including but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, hurricanes, tsunami, loss of utilities, ect. In the event of a resort closure all deposits and rents would be returned with that being your sole remedy for any and all damages.We will be careful to avoid conflicts with reservations; however, if through errors/omissions the unit is otherwise unavailable for any reason on the dates of the rental agreement we will attempt to find a substitute accommodation of a similar quality/price range. If there is no replacement property found or if you reject the replacement a refund of all deposits and rents you paid shall be your sole remedy for any and all damages, liability or inconvenience arising out of the error.

CREDIT CARD AUTHORIZATION/TERMS/ADDITIONAL CHARGES:

I understand and consent to the use of the credit card provided without original signature on the charge slip. I understand that by "clicking" that I have read the Terms and Conditions of this property and I am bound by this agreement. Also I have signed "electronically"and that this Credit Card Authorization cannot be revoked and will not terminate until all additonal charges, if any, are paid. Guest assumes full responsibility for the payment of any outstanding amount due along with any additional charges which may include but not limited to: unauthorized long distance, telephone charges, damages that are not accidental, theft, unreturned keys, missing towels, additional cleaning fees, ect. Guest gives owner authorization to charge cr edit card on file for any addtional charges that are incurred.

SHORT-TERM RENTAL:

It is expressly understood and agreed that this is a short-term vacation rental and is not a lease or other long term residential tenancy agreement. This agreement is only for the use of the property for the stated term. It creates no property rights in you, the Guest, and no rights to renewal or for recurring use. Guest may not let, sublet or assign this lease for all or any part of the premises without prior consent of the owner.
