SeaShell River Rental TERMS and Conditions/ Rental Contract
SeaShell River Cabin, is located at 38 Misty Manor, Drake, CO 80515
- CHECK-IN TIME IS AFTER 4 P.M. MST AND CHECK OUT IS BEFORE 11 A.M. MST. NO Early Check-ins or late check-outs without prior permission.
- This is a NON-SMOKING and PET FREE cabin. No smoking is allowed neither inside nor outside the cabin. If you are a smoker or plan to bring pets, please seek alternative accommodations. If you SMOKE or BRING a PET, YOU WILL LOSE YOUR SECURITY DEPOSIT and be charged additional damage.
- The water for the cabin is served by a well. We request the guests to be cautious and not leave faucets or water running as it can run the well dry.
- DAMAGE/RESERVATION DEPOSIT- A damage/reservation deposit of $250 is required. The deposit automatically converts to a security/damage deposit upon arrival.
Maintenance or any issues must be reported immediately to owners. Owners must be given a chance to rectify the problems before complaints or requests for refund are made.
The cabin is owner operated, and we the owners typically clean in between rentals to give the best rental experience. We charge a nominal cleaning fee and do not charge exorbitant cleaning fees typically charged by rental companies. However, there is "a leave as you found it condition policy" for the cabin except for linens. After your departure, if it takes more than 3 hours to clean, you will be charged an extra $45/hour for additional hours taken out of your security deposit. The security deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met.
- No damage is done to cabin or its contents, beyond normal wear and tear.
- The cabin is located where bears look for garbage, so garbage safety is important for upmost safety of the guests as well as the bears. All debris, rubbish and discards are placed in refuse containers outside, with a maximum of 3 large black garbage bags (this maximum of 3 bags is mandated by Estes Park Waste Management and not us). Put the garbage in bear proof garbage container. No loose garbage please.
- Please ensure that soiled dishes are cleaned. Do not leave dirty dishes in the sink. Put the dishes away.
- You do not need to make the beds or clean the linens.
- Leave the place including bathrooms reasonably clean. You need not overdo cleaning.
- Before final departure, ensure leave keys are left in the lock box and that the cabin is left locked
- No linens are lost or damaged.
- No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
- The cabin is served by a well. Please ensure that water usage is conservative. Please do not leave faucets or toilets running as it will dry the well.
- MAXIMUM OCCUPANCY: This cabin accommodates FOUR (4) guests; typically, 2 adults and 2 children comfortably. It is illegal to accommodate more than FOUR (4) guests. Renters are not allowed to exceed the number of guests as per Estes Park Rental Authority. We as business owners will lose our license to operate the business. Violation of this agreement will cause YOU to lose your entire security deposit as well as additional fines will be imposed. We do not allow large events at this cabin to take place at this cabin due to the well conditions.
- PARKING –Parking is limited to two (2) vehicles. Vehicles are to be parked in designated parking area only. The designated parking is beyond the cabin, just next to it on the right. There are red reflectors on the corners the parking spot. There is additional parking across the road that is marked. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees and is the sole responsibility of the vehicle owner. Do not park on the neighbors’ property or in the grass in front of the cabin.
- SEWER system - Cabins by the river are mandated by the Health Department to have an enclosed sewer system that is emptied on a regular basis. I agree to conserve on the water and do not leave faucets or the toilet running.
- RESPECT and NOISE – QUIET time is after 9 pm MST. This cabin is located near private cabins. Please ensure that you respect neighbor(s) privacy while enjoying your stay. You are free to enjoy your cabin within its designated lot. Please do not stray into neighboring lots or disturb the neighbors.
- PEST POLICY CONDITIONS – This cabin is in an area where there is wildlife. There are chipmunks, squirrels, and mice around the cabin. If the doors are left open, these animals may enter the cabin. No refunds will be given for animals entering the house. Guests are informed that there is a difference between this situation and pest infestation. There is no pest infestation at this cabin.
- PAYMENT – An advance payment equal to approximately 50% of the rental rate is required upon making the reservation. The advance payment will be applied toward the room rent. Please make payments in the form of credit card, traveler's checks, bank money orders, cashier’s checks or personal checks payable to Janet Ali. The advance payment is not a damage deposit. The BALANCE OF RENT is due 21 days before your arrival date.
- CANCELLATIONS – A sixty (60) day notice is required for cancellation. Cancellations made more than sixty (60) days prior to the arrival date will incur no penalty except for the PayPal and Credit Card transaction fees involved. Cancellations or changes that result in a shortened stay, or those that are made within 60 days of the arrival date, forfeit the full advance payment and damage/reservation deposit. Credit card cancellations are subject to a 5% Cancellation fee or $50 whichever is greater. PayPal cancellations are subject to a 3% Cancellation fee or $50 whichever is greater. Cancellation or early departure does not warrant any refund of rent or deposit.
- MINIMUM STAY- THIS PROPERTY REQUIRES A THREE (3) or (5) NIGHT MINIMUM STAY. Exceptions to the above requires prior approval.
- INCLUSIVE FEES – Rates include a one-time linen-towel setup. Amenity fees are included in the rental rate.
- NO DAILY MAID SERVICE – While linens and bath towels are included in the cabin, daily maid service is not included in the rental rate. We suggest you bring your own beach towels. We do not permit towels or linens to be taken from the cabins.
- KITCHEN MAINTENANCE - Only nonabrasive cleaners may be used to clean the kitchen sink.
- RATE CHANGES – Rates subject to change without notice. Agreed upon rates will not change.
- FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.
- WRITTEN EXCEPTIONS – Any exceptions to the above-mentioned policies must be approved in writing in advance.
- STORM POLICY/ROAD CONDITIONS – No refunds will be given for storms or road conditions. The road to the cabin is maintained by a joint committee of cabin owners and not by the county. Gravel drives are maintained when the committee approves, but there can be excessive run off due to storm, rain and snow conditions. However, we highly recommend four-wheel drive during the snow months. Mountain roads can be curvy and steep.
- This cabin is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
- EVACUATIONS AND EMERGENCY PROCEDURES. Guests are responsible for keeping updated on local weather, fire, flood and evacuation forecasts and procedures. Please check https://www.larimer.org/emergency/LC_Preparedness_Guide_Digital.pdf and FEMA broadcasts and take responsibility for your own safety. The owners are not responsible for providing emergency, evacuation updates and procedures.
- OUTDOOR SECURITY CAMERA – We respect the privacy of our guests. There is a camera facing the door entrance only. There are no cameras facing the deck or any outdoor scenic areas that guests typically enjoy. This camera is used for general security and theft prevention. Tampering or disabling the outdoor security camera is not allowed. A fine in the amount of the cost of damage plus labor and time will be charged to the guest if this occurs. We do not have any cameras indoors.
