Please print these Terms and Conditions for your records.
The property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease and must be vacated by 10:00 AM local time on the ending date of the lease. This is a Saturday to Saturday Rental. During high season, some units may not be ready by 4 p.m., your patience is appreciated.
The PREMISES is located at: 17 Cottage Row, Miramar beach, Florida 32550
SECURITY DEPOSIT: In lieu of a security deposit we will hold your credit card on file. If there are damages to this unit during your stay, we will bill your credit card and send you an invoice. You agree to this by booking this unit. The balance of rent and any other fees are due 60 days before you arrive. You can mail a check to JSRE / Kastlekeepers LLC. This information will be emailed to you. If you are booking this within 60 days of arrival, the total amount is due at time of booking.

ACCIDENTAL RENTAL DAMAGE INSURANCE:Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

Any damage noticed upon arrival should be reported to the owner immediately. If damage is not reported, your credit card may be charged for the cost of the repair. All general maintenance should also be reported so the unit can be kept in good repair. In order to not have your credit card charged, the following must occur:
  • a) No damage is done to the unit or its content including the linens.
  • b) No items are missing upon the inventory check. (This includes, but is not limited to, transferring items to other units.
  • c) All debris, garbage and discards are placed in proper containers.
  • d) All soiled dishes are placed in the dishwasher.
  • e) There was no exceeding the maximum occupancy of the unit.
  • f) There was no smoking or evidence of smoking in a designated non-smoking unit.
  • g) Unit is left in neat condition.
PLEASE BE SURE TO READ THE CHECK OUT PROCEDURES AT THE BOTTOM OF THIS PAGE.
SEVERE WEATHER - We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do no warrant refund of rent or deposit.
Hurricane Policy and Tropical Storm Policy
We do not offer any refunds for Hurricanes or Tropical Storms. We highly recommend getting TRAVEL Insurance for your trip. It is up to the Guest to purchase this coverage for their trip.

GRILLS: No grills are permitted at this unit. There is a grilling area next to the pool. Local fire regulations prohibite the use of grills on the porches or in the community due to the proximity of the roofs and other units. Please use the charcoal grills at the pool if you would like to grill your food.
This lease is between the LESSEE or Guest and JSRE/Kastle Keepers LLC or LESSOR. JSRE/Kastle Keepers LLC is the management comany that operates this unit.
COMMUNITY RULES: Guest agree to abide by rules of the community. These may be posted in the unit or at the community pool or office. These rules may change from time to time.
COTTAGE RETREAT RULES AND REGULATIONS
Revised 10/25/2009
1. All students must be accompanied by a parent, present in the unit for the entire stay. Unaccompanied groups
of students are not permitted (see attached Group Rules and Regulations)
2. There must be a minimum of one parent for each four children, present in the unit for the entire stay.
3. No boats, trailers, recreational vehicles, jet-skis, campers or commercial vehicles may park in Cottage Retreat
or the Beach Retreat parking lot. Such vehicles will be towed at the vehicle owner's expense.
4. Parking is limited to two vehicles per Cottage. Vehicles must display a parking pass at all times. Nonpermitted,
un-authorized and non-identified vehicles will be towed at the vehicle owner's expense.
5. Cottage Retreat residents, tenants or guests shall not park their vehicles in the Beach Retreat Condo parking
lot. Such vehicles will be towed at the vehicle owner's expense.
6. No activity that would constitute a disturbance including loud noise is permitted after 10 p.m. and before 8
a.m.
7. Pool rules must be followed at all times, including hours of use. Please read the regulations as you enter the
pool area.
8. No clothing, towels or objects may be hung from balconies.
9. Nothing may be thrown from the balconies.
10. Fines will apply for littering anywhere on property.
11. Household garbage must be placed in Garbage Dumpster located in the Garbage Enclosure. Fines will apply
for improper trash disposal.
12. Pets must be on leash when on property. Walk pets in the designated area only, and dispose of droppings with
a bag and scoop.
13. No open flame devices, gas grills or charcoal grills of any sort are permitted. Please use designated grilling
area.
14. Keep the grilling area clean. Use the provided garbage containers, and do not leave anything behind.
15. Fines of $100 per violation per day or occurrence, to a maximum of $1,000 per violation, of any of the
Association Regulations and Rules shall be levied.
16. Eviction of tenants who violate Regulations or Rules shall be implemented if needed. Management and/or
Security personnel shall make the decision to take this action if in their judgment it is needed.
Occupants must comply with all regulations of the Cottage Retreat Association as presented from time to time, and the
Covenants of the Association. Owners shall provide the regulations to all rental customers, rental
management companies and guests.
POOL RULES
NO DIVING
No lifeguard on duty; swim at your own risk
No animals in pool or on pool deck
No food in pool or on pool deck
No alcohol or glass in pool area
No smoking in pool area
No running or rough play
Children under 12 years of age MUST be accompanied by an adult
Children MUST be potty trained or wear swim diaper to enter pool

SPA RULES
ABSOLUTELY NO DIVING
Fifteen (15) Minutes MAXIMUM use
Pregnant women, people with health problems and people using alcohol, narcotics or other drugs causing
drowsiness should NOT use the spa without first consulting a doctor.
Use Spa Carefully And at Your Own Risk.
Do NOT climb on Fountain Ledge of Spa
No children under 12 permitted in spa

COTTAGE RETREAT RULES AND REGULATIONS REGARDING GROUPS
1. Any group booking, regardless of number, must notify the Association Manager in
advance. If a group is comprised of underage (under 25 years old) participants, the
Association Manager will need their names, what unit they will be staying in and the
parent/guardian (not chaperone) that will be assigned to that unit.
2. A 24/7 phone number for the parent/guardian for each unit shall be made available to the
Association Manager. This information shall be provided as soon as the reservation
occurs and well in advance of their arrival.
3. All owners and management companies must be required to abide by occupancy
guidelines set forth by the Board. There shall be no more occupants in a home, than
beds provided (no temporary bedding permitted).
4. There will be zero tolerance of misbehavior or disturbances. The Cottage Retreat
Association will hire adequate security to monitor all rental homes for compliance to our
Rules and Regulations.
5. The parking rules shall be followed and will be strictly enforced. See Rules 3, 4, and 5 in
"Cottage Retreat Rules and Regulations"
Parking: You may park up to 2 cars in front of this unit. You will be issued 2 parking passes when you arrive at the unit. No others cars are permitted to park in the community. Cars without passes may be towed at the guest expense.
Please make sure that ALL future rental guests understand the parking rules and that it is illegal to park their vehicles in the Beach Retreat condo parking lot. Your future rental guests should also know that Beach Retreat has the right to tow any unauthorized vehicle from the Beach Retreat condo parking lot at the owners expense, without any warning, and they have expressed to me that they will do so in the future.
Parking: Each Cottage has parking space for only two vehicles. Two Green Parking permits are supplied for these vehicles. Additional vehicles may secure Reserved Parking Space Permits for the cost of $10/day or $70/week per space. Reserved Parking Space(s) must be reserved AT LEAST TWO WEEKS before the Arrival Date of the extra vehicle(s). Any additional vehicle that arrives on-site without a prior reservation will be subject to an ADDITIONAL LATE RESERVATION FEE OF $5/DAY per Space, if space is available. Reservations made "on-arrival" must be paid in cash.

The following information is regarding the reserved parking spaces. These are the eight (8) spaces that are located near the pool on property. These passes are to be purchased in advance and all communication goes through email.

DO NOT CALL US TO MAKE RESERVATION. ALL RESERVATIONS ARE TO BE HANDLED VIA EMAIL.

AFTER THE EMAIL REQUEST IS MADE, THE PARKING PERMIT/INVOICE WILL BE SENT BACK TO THE REQUESTOR VIA EMAIL AS A “ PDF” FILE SUITABLE FOR PRINTING.

THE PARKING PERMIT MUST BE PLACED ON THE DASHBOARD OF EACH CAR.

MOVING FORWARD, SOUTHERN ASSOCIATION WILL NOT BE PRINTING OUT ANY PARKING PERMIT( S) IN THE MAIN OFFICE. IT IS THE RESPONSIBILITY OF THE GUEST AND THE RENTAL COMPANY. PLEASE BE SURE TO NOTE THIS MOVING FORWARD, AS NO EXCEPTIONS WILL BE MADE.

Minimum Stay: This is a weekly rental. Saturday to Saturday. If you have a question about a longer stay please contact the owner direct.
INCLUSIVE FEES- Rates include a one-time linen setup and cleaning service at the time of departure. There is NO DAILY MAID SERVICE. Guests will need to provide their own paper items and cleaning supplies. An initial set up of trash liners and toiletries is provided. Extra items needed are the responsibility of the guest. (ie Bring your tooth paste, laundry detergant, soap, beach towels, extra toilet paper etc.)
UTILITIES: The landlord will provide water, heat, electric, trash removal and local telephone usage. Lessee is responsible for all long distance calls made during tenancy.
RESTRICTIONS: No RV's, trailers, boats, jet skis or motorcyles allowed inside the gated community. No grills allowed at the home. There is a "Grilling area" next to the pool.
ACCOMMODATIONS: Two King beds, One queen sofa sleeper, 2 twin beds and 2 bunk beds. Lessee supplies linens for beach use.
MAXIMUM NUMBER OF OCCUPANTS: The house is to be occupied by no more than 10 ( Ten )persons at a maximum. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. No chaperoned groups VIOLATION OF THIS PROVISION SUBJECTS LESSEE TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM SUMMER VACATION RENTAL.
FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.
LESSEE assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
LESSEE assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).
LESSEE agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
LESSEE and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.
LESSEE agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
LESSEE agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the LESSEE, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.
LESSEE agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.
Upon not less than 24 hours notice, LESSEE shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants. In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from LESSEE.
LESSEE may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.
If LESSEE abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.
In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.
Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.
The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners are required to conform to all Policies and Procedures. Violators are subject to eviction according to Florida Statute 509.141.

LESSEE assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the LESSEE.
PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION. VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVER USE OF THE SEWER .THEREFORE, IN THE EVENT LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN 10 ( Ten )persons , LESSEE SHALL BE RESPONSIBLE TO PAY LESSOR.THE-SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS OF 10 ( Ten )persons PER DAY FOR EACH DAY THE LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN 10 ( Ten )persons .
Cancellation Policy: Cancellation or changes of reservations with advance payments. Cancellations that are made more than (60) days prior to the check in date will forfeit a minimum charge of $ 50.00. Cancellations that are made within (60) days of the check in date forfeit the full advance payment. Any changes that are made more than sixty (60) days prior to the check in date will not be penalized. Any changes made within (60) days of the check in date that result in a shortened stay, change of dates, change of location or unit, may result in loss of entire advance payment. Cancellations and early departures due to inclement weather do not warrant any refund of rent.
CREDIT CARD AUTHORIZATION: I understand and consent to the use of the credit card provided without original signature on the charge slip, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not be limited to: unauthorized long distance telephone and cable TV charges; damages beyond normal wear and tear; unreturned keys, and parking infractions.
All persons using the pool area do so at their own risk and sole responsibility. KIDS MUST BE SUPERVISED ALL THE TIME IN THE POOL AREA. Owners assume no responsibility for any accident or injury in connection with such use. Persons using the pool agree with the Owners for and in consideration of the use of the pool, to make no claim against the owners for or on account of any loss of life, personal injury, or damage to or loss of personal property.
Check Out Procedures
We know you are on Vacation and we do appreciate your business. But we do have to ask that you abide by our Check Out Procedures. The main reason for this is so we can get the unit ready for the next guest. They arrive only hours after you leave. If you leave the unit in great shape, the next family can have access to the unit on time. We really appreciate you following these procedures.
Most of our guest follow all of these rules very nicely, but for the few that do not, this is notice that a $50.00 fee per incident or per hour which ever applies will be charged to your credit card.
1. Check-out time is by 10:00 am local time. Our managers and cleaners arrive at 10:00 am to start cleaning the unit.
2. Make sure you lock the door when you leave.
3. Take ALL of the trash in the unit, including the bathrooms and bedrooms, to the dumpsters at the north end of the property. This is the most common problem.
4. Put ALL dishes in dishwasher, put soap in and turn on.
5. Wipe down all kitchen counters and sweep the floors.
6. COMPLETELY empty the refrigerator.
7. Bring all used towels to the laundry room. We provide a washer and dryer and soap for your use. We do encourage you to do laundry during the week to keep up with the load of laundry.
8. Leave beds unmade that have been used.
9. Make sure outdoor furniture is in original position.
Please leave the home neat and orderly to avoid additional charges. If the cleaning crew finds that the home has been left excessively dirty you will be billed for the additional cleaning time at a rate of $50 per hour.
Please leave the house in as good as shape as possible. The cleaner we find it, the faster we can turn it over to the next guest. We appreciate your help.
Damages: You are responsible for any and all damages that occur to the property or it's contents by you or any other member of your group while you are the registered occupant of the property. In lieu of a security deposit we will keep your credit card on file as a security deposit. If we discover that there has been damage to the property or it's contents while you are the occupant we will capture an amount from your credit card to cover the estimated cost of repairs. The amount we capture will be an estimate and will probably be more than the actual cost of repairs. We will provide a statement of the damages and the cost of the repairs after they have been completed. If there is a refund due it will be returned to the credit card after all repairs have been made.
If the cleaning company detects any evidence of smoking in the homes not specifically listed as a smoking home you will be billed an additional $200 to deodorize the home.

ACCIDENTAL RENTAL DAMAGE INSURANCE: An insurance policy is in place with this rental. Accidental Rental Damage Insurance through Travel Guard is added to this booking. This provides $3,000 in Accidental Damage coverage to this property. Please see the policy details that are emailed to you or on the booking page. You will be charged on your credit card for any damages that are over $3,000 or that do not fall into this policy coverage. Per the damages policy in this document.
