Please print these Terms and Conditions for your records.
The property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease and must be vacated by 10:00 AM local time on the ending date of the lease. This is a Saturday to Saturday Rental. During high season, some units may not be ready by 4 p.m., your patience is appreciated.
The PREMISES is located at: 1160 Scenic Gulf Drive unit 907A, Miramar beach, Florida 32550
SECURITY DEPOSIT: In lieu of a security deposit we will hold your credit card on file. If there are damages to this unit during your stay, we will bill your credit card and send you an invoice. You agree to this by booking this unit. The balance of rent and any other fees are due 60 days before you arrive. You can mail a check to JSRE / Kastlekeepers LLC. This information will be emailed to you. If you are booking this within 60 days of arrival, the total amount is due at time of booking.

ACCIDENTAL RENTAL DAMAGE INSURANCE:Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $3,000. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

Any damage noticed upon arrival should be reported to the owner immediately. If damage is not reported, your credit card may be charged for the cost of the repair. All general maintenance should also be reported so the unit can be kept in good repair. In order to not have your credit card charged, the following must occur:
  • a) No damage is done to the unit or its content including the linens.
  • b) No items are missing upon the inventory check. (This includes, but is not limited to, transferring items to other units.
  • c) All debris, garbage and discards are placed in proper containers.
  • d) All soiled dishes are placed in the dishwasher.
  • e) There was no exceeding the maximum occupancy of the unit.
  • f) There was no smoking or evidence of smoking in a designated non-smoking unit.
  • g) Unit is left in neat condition.

SEVERE WEATHER - We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do no warrant refund of rent or deposit.
Hurricane Policy and Tropical Storm Policy
We do not offer any refunds for Hurricanes or Tropical Storms. We highly recommend getting TRAVEL Insurance for your trip. It is up to the Guest to purchase this coverage for their trip.

GRILLS: Grills are not permitted on the condo balconies.
COMMUNITY RULES: Guest agree to abide by rules of the community. These may be posted in the unit or at the community pool or office. These rules may change from time to time.
Parking: You may park in the Garage across from Majestic Sun in any available spots. There is no assigned parking available.
Minimum Stay: This is a weekly rental. Saturday to Saturday. If you have a question about a longer stay please contact the owner direct.
INCLUSIVE FEES- Rates include a one-time linen setup and cleaning service at the time of departure. There is NO DAILY MAID SERVICE. Guests will need to provide their own paper items and cleaning supplies. An initial set up of trash liners and toiletries is provided. Extra items needed are the responsibility of the guest. (ie Bring your tooth paste, laundry detergant, soap, beach towels, extra toilet paper etc.)
UTILITIES: The landlord will provide water, heat, electric, trash removal and local telephone usage. Lessee is responsible for all long distance calls made during tenancy.
RESTRICTIONS: No trailers, boats, jet skis or motorcyles allowed on property.
ACCOMMODATIONS: One King bed, Two Bunk beds, and one queen sleeper sofa. Lessee supplies linens for beach use.
MAXIMUM NUMBER OF OCCUPANTS: The house is to be occupied by no more than 6 (Six) persons at a maximum. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. No chaperoned groups VIOLATION OF THIS PROVISION SUBJECTS LESSEE TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LESSOR BECAUSE OF THE FACT THAT THIS LEASE IS A SHORT TERM SUMMER VACATION RENTAL.
FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.
LESSEE assures the LESSOR that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
LESSEE assures the LESSOR that any tenant who violates any of the terms of this Lease shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s).
LESSEE agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
LESSEE and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.
LESSEE agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
LESSEE agrees to indemnify and save LESSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the LESSEE, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.
LESSEE agrees that he/she shall not paint or make alterations to the property, including changing existing locks or adding new ones, without the LESSOR'S written consent.
Upon not less than 24 hours notice, LESSEE shall make available to LESSOR or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants. In an emergency, LESSOR or his agent may enter the premises at any time without securing prior permission from LESSEE.
LESSEE may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LESSOR.
If LESSEE abandons or vacates the premises, LESSOR may at his option terminate this lease, enter the premises, and remove all property.
In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney's fees as fixed by the Court in addition to all relief at law or equity.
Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner and as provided by law.
The Policies and Procedures above are meant to protect our guests and owners alike. All guests, as well as owners are required to conform to all Policies and Procedures. Violators are subject to eviction according to Florida Statute 509.141.

LESSEE assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the LESSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the LESSEE.
PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION. VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEWER .THEREFORE, IN THE EVENT LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN 6 (Six) , LESSEE SHALL BE RESPONSIBLE TO PAY LESSOR.THE-SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS OF 6 (Six) PER DAY FOR EACH DAY THE LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN 6 (Six) PERSONS.
Cancellation Policy: Cancellation or changes of reservations with advance payments. Cancellations that are made more than (60) days prior to the check in date will forfeit a minimum charge of $ 50.00. Cancellations that are made within (60) days of the check in date forfeit the full advance payment. Any changes that are made more than sixty (60) days prior to the check in date will not be penalized. Any changes made within (60) days of the check in date that result in a shortened stay, change of dates, change of location or unit, may result in loss of entire advance payment. Cancellations and early departures due to inclement weather do not warrant any refund of rent.
CREDIT CARD AUTHORIZATION: I understand and consent to the use of the credit card provided without original signature on the charge slip, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include but not be limited to: unauthorized long distance telephone and cable TV charges; damages beyond normal wear and tear; unreturned keys, and parking infractions.
All persons using the pool area to do so at their own risk and sole responsibility. KIDS MUST BE SUPERVISED ALL THE TIME IN THE POOL AREA. Owners assume no responsibility for any accident or injury in connection with such use. Persons using the pool agree with the Owners and JSRE/Kastlekeepers LLC, for and in consideration of the use of the pool, to make no claim against the owners or JSRE/Kastelkeepers LLC for or on account of any loss of life, personal injury, or damage to or loss of personal property.

RULES AND REGULATIONS

WELCOME to the Majestic Sun Condominiums. We hope you enjoy your stay here. The following information has been put together in order to answer any questions you may have while staying at our resort.

CHECKING IN – There is no check-in desk located at Majestic Sun. You must contact your rental manager or owner for information on how to check-in to your unit.

AGE RESTRICTIONS – No Residential unit may be rented or leased to a person who has not attained the age of twenty-five (25) years without a parent or legal guardian. The legal parent or legal guardian must reside in the Residential Unit for the duration of the stay.

NO SMOKING – Majestic Sun is a Smoke Free Facility! No smoking is allowed in all common areas, including the garage, walkways, pools, spa, pool decks, as well as on the Limited Common Element Balconies. Smoking is only allowed within the walls of the unit if the owner allows. ( WE DO NOT ALLOW SMOKING IN THE UNIT! ) The act of smoking includes the use of the following: tobacco cigarettes, electronic cigarettes, ( Egigarettes), cigars, pipes. If a guest is noticed smoking on a balcony we will advise the owner and their management company via email and put a notice on the door. If the guest does not stop it is policy that we fine the owner $100 a day up to $1000.

PET POLICY – There is a no pet policy for all guests. Owners only are allowed to have pets on property. (The No Pet policy also applies to family members and friends of owners.) The only exception to this policy is a Service Dog. In this case, you would be expected to provide proper documentation and register it with the Association office.

FEEDING BIRDS – Do not feed the birds.

BALCONY’S – Do not hang or display any items from the balcony or railings.

PARKING PASSES – Parking passes are required. The rental agency or person that you rented your unit through should have provided you with the appropriate parking pass and such pass must be displayed in the windshield of your vehicle during the entirety of your stay.

LOCK OUTS – If you get locked out of your unit you must contact your RENTAL AGENCY or the INDIVIDUAL that you rented from to regain access to your unit. The Association’s management company is not permitted to give a guest access to a unit.

PROBLEMS WITH YOUR UNIT – If you experience a problem with your unit (e.g., HVAC, hot water, appliances, etc.) you will need to contact the rental company or individual that you rented from. Do not call/contact the Association’s management company for repairs applicable to the unit or its furnishings.

LOST & FOUND – There is a lost and found box in the Homeowner’s Association Office which is located on the ground floor in Building A between the lobby and the entrance to the indoor pool. Office hours are Monday through Friday from 8am-5pm. If an item was left on the pool deck or fitness room you can also see the Pool Attendant.

QUIET TIME – The associations Rules and Regulations call for all owners and guests to refrain from any activity that would disturb other residents between the hours of 10pm and 10am. Owners, guests and vendors shall keep noise at a level that cannot be heard outside the unit in which they are staying during these times.

Pool Bands - There are 6 pool bands left in the condo for your use. Please ensure that they are left upon departure to avoid a charge.

SECURITY – Majestic Sun has night security available during season (spring break-summer). If you have the need for security, please call 850-499-6448 or if it is an emergency or is off season, you can contact the Walton County Sherriff’s Office at 850-267-2000.

GOLF – Guest who would like to schedule a golfing tee time at Seascape will need to contact the Golf Pro Shop at 850-654-5609.

THINGS TO REMEMBER

  1. Dropping or throwing items from a balcony or breezeway can result in serious injury or death and thus is a felony charge in the State of Florida. Individuals throwing items from a balcony or breezeway will have their rental contract voided and the entire party will be evicted from their unit.
  2. In order to be in compliance with the State of Florida and local fire codes, the breezeways/walkways must be kept clear of all objects. Please do not leave any items on the walkways outside of your unit. All items left on the walkways will be disposed of.

  1. Watch Channel 12 on the TV in your unit for important information about the resort including various gate and access codes.
  2. Each unit has internet service. However, the wireless internet access may or may not be available and varies from unit to unit. If you have any internet questions contact Miracle Strip Wireless 850-622-0622.

  1. Guests are required to have a wristband to be on the pool deck and in the fitness center. The pool attendants will be looking for your wristbands; Please keep them visible in order to avoid us interrupting your visit at the pool deck or the fitness center.
  2. Please observe the rules and regulations that are posted on the pool deck, which include but not limited to, no open containers in or within four (4) feet of the pool or spa, no smoking and no children in the spa under the age of twelve (12). Children under the age of twelve (12) may not use the pool or fitness center unless accompanied by an adult over the age of eighteen (18).

  1. The pool deck and fitness center hours are from 8am to 10pm. In case of life threatening weather and/or lightening, the pool deck will be closed and access not allowed until all threatening weather has passed.
Check Out Procedures
We know you are on Vacation and we do appreciate your business. But we do have to ask that you abide by our Check Out Procedures. The main reason for this is so we can get the unit ready for the next guest. They arrive only hours after you leave. If you leave the unit in great shape, the next family can have access to the unit on time. We really appreciate you following these procedures.
Most of our guest follow all of these rules very nicely, but for the few that do not, this is notice that a $50.00 fee per incident or per hour which ever applies will be charged to your credit card.
1. Check-out time is by 10:00 am local time. Our managers and cleaners arrive at 10:00 am to start cleaning the unit.
2. Make sure you lock the door when you leave.
3. Take ALL of the trash in the unit, including the bathrooms and bedrooms, to the trash shoot at the north end of the hallway. This is the most common problem.
4. Put ALL soiled dishes in dishwasher, put soap in and turn on.
5. Ensure that all pool bands are accounted for to avoid a charge.
6. COMPLETELY empty the refrigerator.
7. Bring all used towels to the laundry room. We provide a washer and dryer and soap for your use. We do encourage you to do laundry during the week to keep up with the load of laundry.
8. Leave beds unmade that have been used.
9. Make sure outdoor furniture is in original position.
Please leave the home neat and orderly to avoid additional charges. If the cleaning crew finds that the home has been left excessively dirty you will be billed for the additional cleaning time at a rate of $50 per hour.
Please leave the house in as good as shape as possible. The cleaner we find it, the faster we can turn it over to the next guest. We appreciate your help.
Damages: You are responsible for any and all damages that occur to the property or it's contents by you or any other member of your group while you are the registered occupant of the property. In lieu of a security deposit we will keep your credit card on file as a security deposit. If we discover that there has been damage to the property or it's contents while you are the occupant we will capture an amount from your credit card to cover the estimated cost of repairs. The amount we capture will be an estimate and will probably be more than the actual cost of repairs. We will provide a statement of the damages and the cost of the repairs after they have been completed. If there is a refund due it will be returned to the credit card after all repairs have been made.
If the cleaning company detects any evidence of smoking in the homes not specifically listed as a smoking home you will be billed an additional $200 to deodorize the home.
